ROAD TRAFFIC (SPEED LIMITS) (COUNTY OF CLARE) REGULATIONS, 1968. |

The Minister for Local Government in exercise of the powers conferred on him by sections 5 , 45 and 46 of the Road Traffic Act, 1961 (No. 24 of 1961) amended as regards the said section 46 by section 25 of the Road Traffic Act, 1968 (No. 25 of 1968) hereby makes the following Regulations:-- |

Citation. | ||
1. These Regulations may be cited as the Road Traffic (Speed Limits) (County of Clare) Regulations, 1968. |
||
Commencement. | ||
2. These Regulations shall come into operation on the 1st day of November, 1968. |
||
Interpretation. | ||
3. In these Regulations save where the context otherwise requires " the Act " means the Road Traffic Act, 1961 ; " road " means a public road ; |
||
" perimeter road " means a road on and along the roadway of which there runs the boundary of a county or other borough, an urban district or a town ; |
||
" special speed limit " and " built-up area speed limit " have the meanings respectively assigned to them in Part IV of the Act ; |
||
" distance " means distance as measured along the centre line of a road. |
||
Built-up area speed limit. | ||
4. (1) Each of the roads described in the First Schedule to these Regulations is hereby declared not to be a public road in a built-up area for the purposes of section 45 of the Act. |
||
(2) Each of the roads described in the Second Schedule to these Regulations is hereby declared to be a public road in a built-up area for the purposes of section 45 of the Act. |
||
Special speed limit. | ||
5. Forty miles per hour shall be the speed limit for mechanically propelled vehicles on the roads specified in the Third Schedule to these Regulations. |
||
Exceptions. | ||
6. There shall be excepted from the special speed limit prescribed in article 5 of these Regulations and from the built-up area speed limit the following :-- |
||
(a) ambulances, |
||
(b) fire brigade vehicles and |
||
(c) vehicles used by members of the Garda Síochána in the performance of their duties as such members. |
||
Revocation. | ||
7. Articles 5 and 6 of the Road Traffic (Speed Limits) Regulations, 1963 ( S.I. No. 18 of 1963 ) in so far as they relate to roads in the County of Clare are hereby revoked. |
||
FIRST SCHEDULE |
||
Roads declared not to be public roads in a built-up area for the purposes of section 45 of the Act. |
||
1. The following roads in the town of Kilkee :-- |
||
(a) The Back Road to Termon, the Lisdeen Road. |
||
(b) The Kilrush Road for a distance of 700 yards from the town boundary. |
||
(c) The Kiltenane or Bansha Road for a distance of 850 yards from the town boundary. |
||
(d) The Doonbeg Road for a distance of 600 yards from the point where the town boundary intersects the north-western side of the road. |
||
(e) The Doonlicky Road for a distance of 1,000 yards from the point where the town boundary intersects the northern side of the road. |
||
(f) The Bog Road between the town boundary and a point 100 yards from its junction with the Circular Road. |
||
(g) The Carrigaholt Road where the said road is a perimeter road. |
||
2. The following roads in the Urban District of Kilrush :-- |
||
(a) The Monvana Road (North), the Monvana Road (South), the Doonbeg Road. |
||
(b) The Ennis Road for a distance of 900 yards from the Urban District boundary. |
||
(c) The Kildysart Road for a distance of 760 yards from the Urban District boundary. |
||
(d) The Knock Road for a distance of 520 yards from the point where the Urban District boundary intersects the northeastern side of the road. |
||
(e) The Shanakyle Road for a distance of 400 yards from the Urban District boundary. |
||
(f) The Pella Road for a distance of 350 yards from the Urban District boundary. |
||
(g) The Cooraclare Road for a distance of 600 yards from the Urban District boundary. |
||
(h) The Kilkee Road for a distance of 900 yards from the Urban District boundary. |
||
SECOND SCHEDULE |
||
Roads declared to be public roads in a built-up area for the purposes of section 45 of the Act. |
||
1. The following roads at Clarecastle :-- |
||
(a) The Fair Green Road. |
||
(b) The Limerick-Ennis road between a point 240 yards south- west of its junction with the Quin Road and a point 50 yards north of its junction with the Fair Green Road. |
||
(c) Patrick Street or Main Street for a distance of 150 yards from its junction with the Limerick-Ennis road. |
||
(d) Quay Road and all roads connecting it with the Limerick- Ennis road. |
||
2. The following roads adjacent to the Urban District of Ennis :-- |
||
(a) The Corravarrin Burial Ground Road, the Golf Links Road or Orchard Lane, St. Michael's Villas. |
||
(b) The Gort Road between the boundary of the Urban District of Ennis at Kelly's Comer and the junction of the said road with the Sandfield Road. |
||
(c) The Sandfield Road for a distance of 20 yards from the boundary of the Urban District of Ennis. |
||
(d) The part of the Lifford Road and its continuation which lies outside the boundary of the Urban District of Ennis. |
||
(e) The Tulla Road for a distance of 300 yards from the boundary of the Urban District of Ennis. |
||
(f) The part of Clonroad and its continuation to Captain Mac's Cross which lies outside the boundary of the Urban District of Ennis. |
||
(g) The Quin Road for a distance of 10 yards from its junction with Clonroad. |
||
(h) The Ennistymon Road for a distance of 140 yards from the boundary of the Urban District of Ennis at Claureen Bridge. |
||
(i) The Drumcliff Road for a distance of 60 yards from its junction with the Ennistymon Road. |
||
(j) The Victoria or Cusack Road where the said road is a perimeter road. |
||
(k) The Kilrush Road for a distance of 440 yards from the boundary of the Urban District of Ennis. |
||
(l) The part of the Clare Road or Limerick-Ennis road which lies outside the boundary of the Urban District of Ennis for a distance of 225 yards from the point where the said boundary intersects the eastern side of the road. |
||
3. The following roads at Ennistymon :-- |
||
All roads in the area enclosed by a line commencing at a point on the Ennis Road 120 yards south-east of its junction with the Circular Road and drawn thence in straight lines successively to the following points : -- |
||
(a) a point on the Pound Road 70 yards east of its junction with the Circular Road, |
||
(b) a point on the Lisdoonvarna Road 110 yards north of its junction with the Sroohill Road, |
||
(c) a point on the Sroohill Road 100 yards north-west of its junction with the Lisdoonvarna Road. |
||
(d) a point on the Lahinch Road 600 yards west of its junction with Bogberry Road, |
||
(e) a point on the Bogberry Road 120 yards south of its junction with the Woodmount Road, |
||
(f) a point on the Woodmount Road 120 yards south-east of its junction with the Bogberry Road |
||
and from the last-mentioned point in a straight line to the commencement point on the Ennis Road. |
||
4. The following road adjacent to the Urban District of Kilrush :-- |
||
The Aylevaroo Road for a distance of 150 yards from the point where it is intersected by the boundary of the Urban District of Kilrush. |
||
5. The following roads at Lahinch :-- |
||
(a) The Lahinch Lanes. |
||
(b) The Ennistymon-Miltown Malbay road between a point 180 yards north-east of its junction with the Liscannor Road and a point 15 yards south of its junction with the road to the National School. |
||
(c) The Liscannor Road for a distance of 850 yards north-west of its junction with the Ennistymon-Miltown Malbay road. |
||
(d) The road to the National School for a distance of 130 yards from its junction with the Ennistymon-Miltown Malbay road. |
||
(e) The Station Road for a distance of 480 yards from its junction with the Ennistymon-Miltown Malbay road. |
||
6. The following roads at Lisdoonvarna :-- |
||
All roads in the area enclosed by a line commencing at a point on the Kilfenora Road 860 yards south-east of its junction with the Ballyvaughan Road and drawn thence in straight lines successively to the following points : -- |
||
(a) a point on the Ennistymon Road 320 yards south-west of its junction with the Ballyvaughan Road, |
||
(b) a point on the Spectacle Bridge Road 280 yards south-west of its junction with the Doolin Road, |
||
(c) a point on the Doolin Road 525 yards west of its junction with the Spectacle Bridge Road, |
||
(d) a point on the Ballyvaughan Road 640 yards north of its junction with St. Brendan's Road, |
||
(e) the terminal point of Ballyinsheen Road, |
||
(f) a point on St. Brendan's Road 200 yards east of its junction with the Ballyvaughan Road |
||
and from the last-mentioned point in a straight line to the commencement point on the Kilfenora Road. |
||
7. The following roads at Newmarket-on-Fergus :-- |
||
(a) The Limerick-Ennis road between a point 250 yards south of its junction with the Ballycar Road and a point 100 yards north of its junction with the Urlan More Road. |
||
(b) The Ballycar Road between its junction with the Limerick- Ennis road and a point 180 yards west of its junction with the Quin Road. |
||
8. The following roads at Scarriff and Tuamgraney :-- |
||
All roads (other than the road set out at reference 4 in the Third Schedule) in the area enclosed by a line commencing at a point on Church Road 680 yards north of its junction with the Feakle Road and drawn thence in straight lines successively to the following points : -- |
||
(a) a point on the Mountshannon Road or Middle Line 420 yards north-east of its junction with the Square, |
||
(b) a point on the Portumna Road 310 yards north-east of its junction with Jones's Road, |
||
(c) the terminal point of Dock Road, |
||
(d) a point on the Killaloe Road 280 yards south-east of its junction with the Ennis Road, |
||
(e) a point on the Ennis Road 170 yards south-west of its southernmost junction with the Killaloe Road, |
||
(f) a point on the Feakle Road 380 yards west of its junction with Church Road |
||
and from the last-mentioned point in a straight line to the commencement point on Church Road. |
||
9. The following roads at Sixmilebridge :-- |
||
All roads in the area enclosed by a line commencing at a point on the Limerick Road 905 yards south of its junction with the Square and drawn thence in straight lines successively to the following points :-- |
||
(a) a point on the Rosmanagher Road 40 yards from its junction with the Shannon Airport or Hurler's Cross Road, |
||
(b) a point on the Shannon Airport or Hurler's Cross Road 145 yards from its junction with the Rosmanagher Road, |
||
(c) a point on the Newmarket-on-Fergus Road 250 yards west of its junction at the Courthouse with the road leading to the Green, |
||
(d) a point on Frederick Square 25 yards south of the junction of the Kilkishen Road with the Broadford Road, |
||
(e) a point on the Oatfield Road 40 yards from its junction with the Square |
||
and from the last-mentioned point in a straight line to the commencement point on the Limerick Road. |
||
THIRD SCHEDULE |
||
Roads in respect of which a special speed limit of 40 miles per hour is prescribed. |
||
1. The following roads adjacent to the Urban District of Ennis :-- |
||
(a) St. Joseph's Terrace. |
||
(b) The Gort Road between its junction with the Sandfield Road and a point opposite the northern boundary of the Ennis District Mental Hospital Grounds. |
||
(c) The Sandfield Road between its junction with the Gort Road and a point 20 yards north of the boundary of the Urban District of Ennis. |
||
(d) Watery Lane or Watery Road for a distance of 30 yards from its junction with the Sandfield Road. |
||
(e) The Clare Road or Limerick-Ennis road between a point 50 yards north of its junction with the Fair Green Road at Clarecastle and a point 225 yards south of the point where the boundary of the Urban District of Ennis intersects the eastern side of the road. |
||
2. The following road at Lahinch :-- |
||
The Ennistymon-Miltown Malbay road between a point 180 yards north-east of its junction with the Liscannor Road and a point 390 yards north-east of the said junction. |
||
3. The following road adjacent to the County Borough of Limerick :-- |
||
The Broadford Road for a distance of 500 yards northeastwards from the boundary between the counties of Limerick and Clare at Athlunkard Bridge. |
||
4. The following road at Scarriff and Tuamgraney :-- |
||
The Ennis-Portumna road between a point 450 yards north of its northernmost junction with the Killaloe Road and a point 270 yards south-west of its junction with the Dock Road. |

EXPLANATORY NOTE |
||
These Regulations replace the Road Traffic (Speed Limits) Regulations, 1963 and 1965, in their application to the County of Clare and alter the speed limits applicable to certain roads in this area. |
||
The Regulations exclude the public roads mentioned in the First Schedule from the scope of the built-up area speed limit prescribed by Section 45 of the Road Traffic Act, 1961 , and declare the public roads mentioned in the Second Schedule to be subject to that speed limit. |
||
The Regulations also prescribe a speed limit of 40 miles per hour in respect of the public roads mentioned in the Third Schedule for all mechanically propelled vehicles. |
||
Ambulances, fire brigade vehicles and Garda Síochána vehicles while being used in the course of duty are excepted from all speed limits by the Regulations. |
