S.I. No. 74/1969:

LOCAL AUTHORITIES (COMBINED PURCHASING REGULATIONS) (AMENDMENT) ORDER, 1969.

LOCAL AUTHORITIES (COMBINED PURCHASING REGULATIONS) (AMENDMENT) ORDER, 1969.

The Minister for Local Government, in exercise of the powers conferred on him by section 19 of the Local Authorities (Combined Purchasing) Act, 1939 (No. 14 of 1939) by this his Order makes the following regulations : --

1. (1) This Order may be cited as the Local Authorities (Combined Purchasing Regulations) (Amendment) Order, 1969.

(2) The Local Authorities (Combined Purchasing Regulations) Order, 1961 ( S.I. No. 37 of 1961 ) and this Order shall be construed as one and may be cited together as the Local Authorities (Combined Purchasing Regulations) Orders, 1961 and 1969.

2. The Local Authorities (Combined Purchasing Regulations) Order, 1961, is hereby amended as follows--

(a) the following paragraph shall be substituted for paragraph (b) of sub-article (1) of article 3--

" (b) accompanied by a completed tender form in the form C.P.2, C.P.2A or C.P.2B in the said Schedule appropriate to the circumstances of the case or in a form to the like effect and where the price is required to be stated by reference to a deposited price list, such price list.",

(b) the following article shall be substituted for article 4--

" 4. Every order for the supply of a commodity required from an official contractor in pursuance of subsection (1) of section 10 of the Act shall state the name and reference number of the commodity as shown in the relevant appointment by the Minister as official contractor and shall be sent by post or delivered to the official contractor or his authorised agent.",

(c) the forms in the Schedule to this Order shall be substituted for the form C.P.2 in the First Schedule,

(d) form C.P.3 shall be deleted from the First Schedule, and

(e) the following paragraph shall be substituted for paragraph (b) of article 5 of the Second Schedule--

" (b) carriage paid to the place of delivery indicated by the local authority in the order requiring a supply of the commodity, or ".

EXPLANATORY NOTE.

The effect of this Order is to make changes in the forms used by applicants for appointment as official contractors for the supply of goods to local authorities, to relieve local authorities from the requirement to use the form hitherto prescribed for ordering commodities from official contractors, and to vary the conditions of supply.
