HEALTH BOARDS REGULATIONS, 1970

The Minister for Health, in exercise of the powers conferred on him by section 4 of the Health Act, 1970 , (No. 1 of 1970), after consultation with the Minister for Local Government and compliance with subsection (4) of that section, hereby makes the following Regulations, as respects which, pursuant to the said section 4, a draft has been approved by a resolution passed by each House of the Oireachtas: --

Citation.

1. These Regulations may be cited as the Health Boards Regulations, 1970.

Definitions.

2. In these Regulations--

" The Act " means the Health Act, 1970 ;

" the Minister " means the Minister for Health;

" registered dentist " means a dentist registered in the register of dentists maintained by the Dental Board;

" registered medical practitioner " means a medical practitioner registered in the register of medical practitioners maintained by the Medical Registration Council, other than a person provisionally registered under section 7 of the Medical Practitioners Act, 1951 (No. 29 of 1951), or temporarily registered under section 3 of the Medical Practitioners Act, 1955 (No. 1 of 1955);

" registered nurse " means a nurse registered in the register of nurses maintained by An Bord Altranais;

" registered psychiatric nurse " means a nurse registered in the psychiatric division of the register of nurses maintained by An Bord Altranais;

"registered pharmaceutical chemist" means a pharmaceutical chemist registered in the register of pharmaceutical chemists maintained by the Pharmaceutical Society of Ireland;

"registered dispensing chemist and druggist " means a dispensing chemist and druggist registered in the register of dispensing chemists and druggists maintained by the Pharmaceutical Society of Ireland.

Commencement.

3. These Regulations shall come into operation on 1st day of October, 1970.

Eastern Health Board.

4. (1) A health board entitled the Eastern Health Board is hereby established.

(2) The functional area of the Eastern Health Board shall be the county borough of Dublin and the administrative counties of Dublin, Kildare and Wicklow.

(3) There shall be thirty-five members of the Eastern Health Board consisting of--

( a ) seven members appointed by the Right Honourable the Lord Mayor, Aldermen and Burgesses of Dublin, four members appointed by the Council of the County of Dublin, two members appointed by the Corporation of Dún Laoghaire, three members appointed by the Council of the County of Kildare and three members appointed by the Council of the County of Wicklow,

( b ) in the case of the first appointment of members, sixteen persons appointed by the Minister and in the case of subsequent appointments--

(i) nine persons appointed by election by registered medical practitioners practising in the functional area of the board;

(ii) one person appointed by election by registered dentists practising in the functional area of the board;

(iii) one person appointed by election by registered nurses (other than registered psychiatric nurses) practising in the functional area of the board;

(iv) one person appointed by election by registered psychiatric nurses practising in the functional area of the board;

(v) one person appointed by election by registered pharmaceutical chemists and registered dispensing chemists and druggists practising in the functional area of the board;

(vi) three persons appointed by the Minister.

(4) The persons appointed under sub-article (3) (b) (i) shall include not less than two consultants in general hospitals, not less than one consultant psychiatrist, not less than two general medical practitioners and not less than one registered medical practitioner with special knowledge or experience in preventive medicine.

Midland Health Board.

5. (1) A health board entitled the Midland Health Board is hereby established.

(2) The functional area of the Midland Health Board shall be the administrative counties of Laoighis, Longford, Offaly and Westmeath.

(3) There shall be thirty members of the Midland Health Board consisting of--

( a ) four members appointed by the Council of the County of Laoighis, four members appointed by the Council of the County of Longford, four members appointed by the Council of the County of Offaly and four members appointed by the Council of the County of Westmeath,

( b ) in the case of the first appointment of members, fourteen persons appointed by the Minister and in the case of subsequent appointments--

(i) seven persons appointed by election by registered medical practitioners practising in the functional area of the board;

(ii) one person appointed by election by registered dentists practising in the functional area of the board;

(iii) one person appointed by election by registered nurses (other than registered psychiatric nurses) practising in the functional area of the board;

(iv) one person appointed by election by registered psychiatric nurses practising in the functional area of the board;

(v) one person appointed by election by registered pharmaceutical chemists and registered dispensing chemists and druggists practising in the functional area of the board;

(vi) three persons appointed by the Minister.

(4) The persons appointed under sub-article (3) (b) (i) shall include not less than one consultant in a general hospital, not less than one consultant psychiatrist, not less than one general medical practitioner and not less than one registered medical practitioner with special knowledge or experience in preventive medicine.

Mid-Western Health Board.

6. (1) A health board entitled the Mid-Western Health Board is hereby established.

(2) The functional area of the Mid-Western Health Board shall be the county borough of Limerick and the administrative counties of Clare, Limerick and Tipperary North Riding.

(3) There shall be twenty-eight members of the Mid-Western Health Board consisting of--

( a ) three members appointed by the Mayor, Aldermen and Burgesses of Limerick, four members appointed by the Council of the County of Clare, four members appointed by the Council of the County of Limerick and four members appointed by the Council of the County of Tipperary North Riding,

( b ) in the case of the first appointment of members, thirteen persons appointed by the Minister and in the case of subsequent appointments--

(i) six persons appointed by election by registered medical practitioners practising in the functional area of the board;

(ii) one person appointed by election by registered dentists practising in the functional area of the board;

(iii) one person appointed by election by registered nurses (other than registered psychiatric nurses) practising in the functional area of the board;

(iv) one person appointed by election by registered psychiatric nurses practising in the functional area of the board;

(v) one person appointed by election by registered pharmaceutical chemists and registered dispensing chemists and druggists practising in the functional area of the board;

(vi) three persons appointed by the Minister.

(4) The persons appointed under sub-article (3) (b) (i) shall include not less than one consultant in a general hospital, not less than one consultant psychiatrist, not less than one general medical practitioner and not less than one registered medical practitioner with special knowledge or experience in preventive medicine.

North-Eastern Health Board.

7. (1) A health board entitled the North-Eastern Health Board is hereby established.

(2) The functional area of the North-Eastern Health Board shall be the administrative counties of Cavan, Louth, Meath and Monaghan.

(3) There shall be thirty members of the North-Eastern Health Board consisting of--

( a ) four members appointed by the Council of the County of Cavan, four members appointed by the Council of the County of Louth, four members appointed by the Council of the County of Meath and four members appointed by the Council of the County of Monaghan,

( b ) in the case of the first appointment of members, fourteen persons appointed by the Minister and in the case of subsequent appointments--

(i) seven persons appointed by election by registered medical practitioners practising in the functional area of the board;

(ii) one person appointed by election by registered dentists practising in the functional area of the board;

(iii) one person appointed by election by registered nurses (other than registered psychiatric nurses) practising in the functional area of the board;

(iv) one person appointed by election by registered psychiatric nurses practising in the functional area of the board;

(v) one person appointed by election by registered pharmaceutical chemists and registered dispensing chemists and druggists practising in the functional area of the board;

(vi) three persons appointed by the Minister.

(4) The persons appointed under sub-article (3) (b) (i) shall include not less than one consultant in a general hospital, not less than one consultant psychiatrist, not less than one general medical practitioner and not less than one registered medical practitioner with special knowledge or experience in preventive medicine.

North-western Health Board.

8. (1) A health board entitled the North-Western Health Board is hereby established.

(2) The functional area of the North-Western Health Board shall be the administrative counties of Donegal, Leitrim and Sligo.

(3) There shall be twenty-seven members of the North-Western Health Board consisting of--

( a ) six members appointed by the Council of the County of Donegal, four members appointed by the Council of the County of Leitrim and four members appointed by the Council of the County of Sligo,

( b ) in the case of the first appointment of members, thirteen persons appointed by the Minister and in the case of subsequent appointments--

(i) six persons appointed by election by registered medical practitioners practising in the functional area of the board;

(ii) one person appointed by election by registered dentists practising in the functional area of the board;

(iii) one person appointed by election by registered nurses (other than registered psychiatric nurses) practising in the functional area of the board;

(iv) one person appointed by election by registered psychiatric nurses practising in the functional area of the board;

(v) one person appointed by election by registered pharmaceutical chemists and registered dispensing chemists and druggists practising in the functional area of the board;

(vi) three persons appointed by the Minister.

(4) The persons appointed under sub-article (3) (b) (i) shall include not less than one consultant in a general hospital, not less than one consultant psychiatrist, not less than one general medical practitioner and not less than one registered medical practitioner with special knowledge or experience in preventive medicine.

South Eastern Health Board.

9. (1) A health board entitled the South-Eastern Health Board is hereby established.

(2) The functional area of the South-Eastern Health Board shall be the county borough of Waterford and the administrative counties of Carlow, Kilkenny, Tipperary South Riding, Waterford and Wexford.

(3) There shall be thirty-one members of the South-Eastern Health Board consisting of--

( a ) two members appointed by the Mayor, Aldermen and Burgesses of Waterford, three members appointed by the Council of the County of Carlow, three members appointed by the Council of the County of Kilkenny, three members appointed by the Council of the County of Tipperary South Riding, two members appointed by the Council of the County of Waterford and three members appointed by the Council of the County of Wexford,

( b ) in the case of the first appointment of members, fifteen persons appointed by the Minister and in the case of subsequent appointments--

(i) eight persons appointed by election by registered medical practitioners practising in the functional area of the board;

(ii) one person appointed by election by registered dentists practising in the functional area of the board;

(iii) one person appointed by election by registered nurses (other than registered psychiatric nurses) practising in the functional area of the board;

(iv) one person appointed by election by registered psychiatric nurses practising in the functional area of the board;

(v) one person appointed by election by registered pharmaceutical chemists and registered dispensing chemists and druggists practising in the functional area of the board;

(vi) three persons appointed by the Minister.

(4) The persons appointed under sub-article (3) (b) (i) shall include not less than one consultant in a general hospital, not less than one consultant psychiatrist, not less than one general medical practitioner and not less than one registered medical practitioner with special knowledge or experience in preventive medicine.

Southern Health Board.

10. (1) A health board entitled the Southern Health Board is hereby established.

(2) The functional area of the Southern Health Board shall be the county borough of Cork and the administrative counties of Cork and Kerry.

(3) There shall be thirty-three members of the Southern Health Board consisting of--

( a ) five members appointed by the Lord Mayor, Aldermen and Burgesses of Cork, seven members appointed by the Council of the County of Cork and six members appointed by the Council of the County of Kerry,

( b ) in the case of the first appointment of members, fifteen persons appointed by the Minister and in the case of subsequent appointments--

(i) eight persons appointed by election by registered medical practitioners practising in the functional area of the board;

(ii) one person appointed by election by registered dentists practising in the functional area of the board;

(iii) one person appointed by election by registered nurses (other than registered psychiatric nurses) practising in the functional area of the board;

(iv) one person appointed by election by registered psychiatric nurses practising in the functional area of the board;

(v) one person appointed by election by registered pharmaceutical chemists and registered dispensing chemists and druggists practising in the functional area of the board;

(vi) three persons appointed by the Minister.

(4) The persons appointed under sub-article (3) (b) (i) shall include not less than two consultants in general hospitals, not less than one consultant psychiatrist, not less than two general medical practitioners and not less than one registered medical practitioner with special knowledge or experience in preventive medicine.

Western Health Board.

11. (1) A health board entitled the Western Health Board is hereby established.

(2) The functional area of the Western Health Board shall be the administrative counties of Galway, Mayo and Roscommon.

(3) There shall be twenty-nine members of the Western Health Board consisting of--

( a ) six members appointed by the Council of the County of Galway, five members appointed by the Council of the County of Mayo and four members appointed by the Council of the County of Roscommon,

( b ) in the case of the first appointment of members, fourteen persons appointed by the Minister and in the case of subsequent appointments--

(i) seven persons appointed by election by registered medical practitioners practising in the functional area of the board;

(ii) one person appointed by election by registered dentists practising in the functional area of the board;

(iii) one person appointed by election by registered nurses (other than registered psychiatric nurses) practising in the functional area of the board;

(iv) one person appointed by election by registered psychiatric nurses practising in the functional area of the board;

(v) one person appointed by election by registered pharmaceutical chemists and registered dispensing chemists and druggists practising in the functional area of board;

(vi) three persons appointed by the Minister.

(4) The persons appointed under sub-article (3) (b) (i) shall include not less than two consultants in general hospitals, not less than one consultant psychiatrist, not less than one general medical practitioner and not less than one registered medical practitioner with special knowledge or experience in preventive medicine.

EXPLANATORY NOTE.

These Regulations establish eight health boards under section 4 of the Health Act, 1970 , and specify the title, define the functional area and specify the membership of each such board.
