MERCHANDISE MARKS (RESTRICTION ON IMPORTATION OF HOSIERY) ORDER, 1970. |

I, PATRICK J. LALOR, Minister for Industry and Commerce, having considered a report of the Merchandise Marks Commission under section 7 of the Merchandise Marks Act, 1931 (No. 48 of 1931) on an application for a restriction on importation order in relation to goods specified in paragraph 4 of this Order, and having complied with section 14 of that Act, hereby, in exercise of the powers conferred on me by section 8 of that Act (as amended by section 7 of the Merchandise Marks Act, 1970 (No. 10 of 1970)), order as follows:-- |

1. This Order may be cited as the Merchandise Marks (Restriction on Importation of Hosiery) Order, 1970. |
||
2. This Order shall come into operation on the 1st day of May, 1971. |
||
3. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order. |
||
4. In this Order " hosiery " means stockings, socks, sockettes, hose, panti-hose and tights. |
||
5. Subject to paragraph 7 of this Order, the importation into the State of hosiery imported by way of trade is hereby prohibited unless the hosiery bears at importation an indication of origin marked on the hosiery and consisting of the words "Made in" (or other words in English denoting manufacture) followed by the name in English of the country in which the hosiery was manufactured. |

6. (1) An indication of origin marked on hosiery pursuant to this Order shall-- |
||
( a ) in the case of hosiery packed in a container suitable for sale by retail, be printed legibly and conspicuously on the container or on a label permanently attached to the container, |
||
( b ) in the case of hosiery either bearing a manufacturer's brand name on the hosiery or not packed in a container suitable for sale by retail, be stamped or printed on, applied by transfer to, or printed on a label permanently attached to, each article of hosiery or, where the articles are put up for sale in pairs, at least one of each pair, and in every case legibly and conspicuously. |

(2) In this paragraph "container" does not include a wrapper not completely enclosing the hosiery. |
||
7. This Order shall not apply to hosiery which is shown to the satisfaction of the Revenue Commissioners to be-- |
||
( a ) hosiery manufactured within the State which is being re-imported, |
||
( b ) hosiery to which section 18 of the Finance Act, 1938 (No. 25 of 1938), or section 18 of the Finance Act, 1946 (No. 15 of 1946), applies, |
||
( c ) orthopaedic or rubberised hosiery, |
||
( d ) hosiery blanks imported for further processing. |

EXPLANATORY NOTE. |
||
The Order prohibits the importation of stockings, socks, sockettes, hose, panti-hose and tights unless they bear an indication of the country of origin. The Order does not apply to orthopaedic or rubberised articles, blanks for further processing, re-imports, articles designed for use by blind persons and articles for international airports. |
