WOOL MARKETING REGULATIONS, 1971.

I, JAMES GIBBONS, Minister for Agriculture and Fisheries, in exercise of the powers conferred on me by sections 11 and 21 of the Wool Marketing Act, 1968 (No. 26 of 1968), hereby make the following regulations:

1. These Regulations may be cited as the Wool Marketing Regulations, 1971.

2. These Regulations shall come into operation on the 3rd day of May, 1971.

3. (1) Subject to Regulations 4 and 5 of these Regulations, fleece wool shall be purchased only on the graded basis specified in paragraph (2) of this regulation and in whole fleeces that are Class A fleeces, Class B fleeces or Class C fleeces.

(2) The graded basis referred to in paragraph (1) of this regulation is one which is either

(a) that specified in the Table to this regulation, or

(b) a graded basis which is both as detailed and as comprehensive as, and the scheme of which is analogous to, that so specified.

(3) In these Regulations

"Class A fleeces" means fleeces of wool which are free from branding fluid, raddle or artificial staining agent and which are not tied with material other than strands of the fleece, are not contaminated with moiety, do not contain oddments, are not decomposed and do not require drying;

"Class B fleeces" means fleeces of wool which contain only so much branding fluid or raddle as is necessary for branding and which are otherwise similar to Class A fleeces;

"Class C fleeces" means fleeces of wool which do not require drying and which are not decomposed but from which daggings have to be removed in accordance with a purchase agreement or which have one or more of the following defects, namely

(i) they are tied with material other than strands of the fleece itself,

(ii) they contain oddments,

(iii) they are branded other than with branding fluid or raddle or are artificially stained with bloom dip,

(iv) they contain more branding fluid or raddle than is necessary for branding,

(v) they are contaminated with moiety;

"oddments" in relation to a fleece means wool other than wool forming part of the fleece.

Faults in Fleece
The ends of the fibres of fleece have become matted together on the flesh side presenting a
15. Matts or Cotts felted appearance
16. Winter Stain Fleece shows a bright yellow colour that will not scout out
17. Blue, Rubby or Peaty Fleece contaminated with peat
18. Heavy Arable Fleece has a high proportion of soil, earth or sand
19. Fine Grey Fleece has grey or black fibres, but otherwise matches the fleeces described opposite reference numbers 1, 2 or 3
20. Crossbred Grey Fleece has grey or black fibres, but otherwise matches the fleeces described opposite reference numbers 4, 5, 6, 7, 8 or 9
21. Grey Blackface Fleeces with more black fibres and kemp than the fleeces described opposite reference numbers 10, 11, or 12 but which otherwise match any of the fleeces so described
22. Dark Grey Blackface Fleeces which match the fleeces described opposite reference numbers 10, 11 or 12 but which have heavy black and kempy fibres
In determining the grade of a particular fleece, being a grade specified above, regard shall be had to the characteristics or faults specified in this Table opposite the mention of the grade.

4. The price payable to a producer at any time for a Class A fleece shall be not less than lp per lb. more than the price payable to a producer at that time for a Class B fleece of the same grade.

5. The price payable to a producer at any time for a Class C fleece shall be the price payable at that time to a producer for a Class B fleece of the same grade reduced for each defect in the fleece specified in column (1) of the Table to this regulation by the amount specified in column (2) of the Table opposite the mention of the defect in the said column (1).

6. Whenever wool is sold by a producer to a registered buyer the registered buyer shall supply to the producer a statement by him containing the following particulars, namely

(a) the quantity of wool sold and in case the wool is not all of the same grade the quantity sold of and the total amount paid for wool of each grade, and

(b) the price or prices per lb. at which the wool was sold by the producer and in case the wool is sold at more than one price the quantity of wool sold at each price.

7. (1) Every registered buyer shall post and keep posited, in accordance with section 21 (2) of the Wool Marketing Act, 1968 (No. 26 of 1968), notice of the prices he is currently offering for the purchase of wool.

(2) In case a registered buyer is buying wool on a graded basis other than that specified in the Table to Regulation 3 of these Regulations, he shall post and keep posted, in accordance with paragraph (3) of this regulation, notice of the graded basis on which he is currently buying.

(3) The notice mentioned in paragraph (2) of this regulation shall

(a) contain particulars of the relevant graded basis which particulars shall be set out in a format similar, or substantially similar, to that of the Table to Regulation 3 of these Regulations,

(b) be posted prominently in the premises in relation to which the person is registered in the register,

(c) be in such characters and in such position or positions that it may be conveniently read by any person who is in the premises for business purposes.

8. The Wool Marketing Regulations, 1970 ( S.I. No. 86 of 1970 ) are hereby revoked.

EXPLANATORY NOTE.

These Regulations prescribe 22 grades of wool as the minimum basis to be used by buyers in purchasing fleece wool and the price increase or reduction to be applied by the buyer to take account of specified qualities or faults in presentation in the wool. They also prescribe that buyers display at their premises the various prices they are offering for wool and for the supply to the producer by the buyer of a statement containing particulars of the wool purchased.
