S.I. No. 18/1972:

GARDA SÍOCHÁNA (APPOINTMENTS) REGULATIONS, 1972.

GARDA SÍOCHÁNA (APPOINTMENTS) REGULATIONS, 1972.

I, DESMOND O'MALLEY, Minister for Justice, in exercise of the powers conferred on me by section 14 of the Police Forces Amalgamation Act, 1925 (No. 7 of 1925), and section 1 of the Garda Síochana Act, 1958 (No. 14 of 1958), hereby, with the approval of the Government, make the following regulations:--

1. (1) These Regulations may be cited as the Garda Síochána (Appointments) Regulations, 1972.

(2) The Garda Síochána (Appointments) Regulations, 1945 to 1960, and these Regulations may be cited together as the Garda Síochána (Appointments) Regulations, 1945 to 1972.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

3. Article 4 (1) of the Garda Síochána (Appointments) Regulations, 1945 (S.R. & O., No. 173 of 1945), is hereby amended by--

(a) the substitution in paragraph (b) for "5 feet 9 inches" of "5 feet 8 inches",

(b) the substitution for paragraph (c) of the following:

" (c) such person--

(i) has qualified for the award of the Leaving Certificate in the Leaving Certificate Examination of the Department of Education, and--

(A) if that certificate was awarded before the year 1969, such person obtained a pass in Irish and English at that examination, or

(B) if that certificate was awarded in the year 1969 or any subsequent year, such person obtained a grade not lower than D in Irish and English at that examination,

or

(ii) is certified by the Civil Service Commissioners to have passed a qualifying educational examination in such subjects and of such standard as the Civil Service Commissioners, after consultation with the Commissioner, shall determine, and"

and

(c) by the substitution for paragraph (d)(inserted by the Garda Síochána (Appointments) Regulations, 1960 ( S.I. No. 38 of 1960 )) of the following:

" (d) (i) the Commissioner is satisfied that such person has, on the relevant date, attained the age of 18 years but not attained the age of 26 years;

(ii) in this paragraph "the relevant date" means--

(a) in the case of a person who has complied with the condition specified in paragraph (c) (i) (A) or (c) (i) (B) of this Article, the first day of the month in which a qualifying educational examination was next held after the date of his application to join the Force, or

(b) in the case of a person who has complied with the condition specified in paragraph (c) (ii) of this Article, the first day of the month in which the qualifying educational examination to which the condition relates was held."

4. Article 4 of the Garda Síochána (Appointments) Regulations, 1958 ( S.I. No. 176 of 1958 ), is hereby amended by the substitution for paragraphs (c) (inserted by the Garda Síochána (Appointments) Regulations, 1960) and (d) of the following:

" (c) she--

(i) has qualified for the award of the Leaving Certificate in the Leaving Certificate Examination of the Department of Education, and--

(A) if that certificate was awarded before the year 1969, she obtained a pass in Irish and English at that examination, or

(B) if that certificate was awarded in the year 1969 or any subsequent year, she obtained a grade not lower than D in Irish and English at that examination,

or

(ii) is certified by the Civil Service Commissioners to have passed a qualifying educational examination in such subjects and of such standard as the Civil Service Commissioners, after consultation with the Commissioner, shall determine, and

(d) (i) the Commissioner is satisfied that she has, on the relevant date, attained the age of 20 years but not the age of 26 years;

(ii) in this paragraph "the relevant date" means--

(a) if she is a person who has complied with the condition specified in paragraph (c) (i) (A) or (c) (i) (B) of this Article, the first day of the month in which a qualifying educational examination was next held after the date of her application to join the Force, or

(b) if she is a person who has complied with the condition specified in paragraph (c) (ii) of this Article, the first day of the month in which the qualifying educational examination to which the condition relates was held".

EXPLANATORY NOTE.

These regulations modify the height and age requirements for admission to the Garda Síochána and allow exemption from the qualifying educational examination to candidates who have been awarded the Leaving Certificate, with a pass--or, as the case may be, at least Grade D--in Irish and English.
