SOCIAL WELFARE (CLAIMS AND PAYMENTS) (AMENDMENT) REGULATIONS, 1972. |

The Minister for Social Welfare in exercise of the powers conferred on him by section 3 of the Social Welfare Act, 1952 (No. 11 of 1952) and section 47 of the said Act (as amended by section 9 of the Social Welfare Act, 1972 (No. 11 of 1972)), hereby makes the following Regulations:-- |

1. (1) These Regulations may be cited as the Social Welfare (Claims and Payments) (Amendment) Regulations, 1972. |
||
(2) These Regulations and the Social Welfare (Claims and Payments) Regulations, 1952 to 1971, may be cited together as the Social Welfare (Claims and Payments) Regulations, 1952 to 1972. |
||
2. Article 16A of the Social Welfare (Claims and Payments) Regulations, 1952 ( S.I. No. 374 of 1952 ) (inserted by article 2 of the Social Welfare (Claims and Payments) (Amendment) Regulations, 1964 ( S.I. No. 118 of 1964 ) and amended by article 2 of the Social Welfare (Claims and Payments) (Amendment) Regulations, 1966 ( S.I. No. 289 of 1966 )) is hereby deleted and the following shall be substituted therefor:-- |

"16A. (1) The Minister may, where it appears to him that the circumstances so warrant, appoint a person to receive and deal with, on behalf of a claimant or beneficiary, |
||
(i) in respect of disability benefit, unemployment benefit, invalidity pension, retirement pension or old age (contributory) pension, so much of the benefit or pension as is payable by virtue of section 26 or section 27 of the Act, |
||
(ii) in respect of widow's (contributory) pension, so much of the pension as is payable by virtue of section 27 of the Act, |
||
(iii) in respect of injury benefit or disablement pension, so much thereof as is payable by virtue of section 10 or section 11 of the Social Welfare (Occupational Injuries) Act, 1966 (No. 16 of 1966). |

(2) The following provisions shall apply to every appointment made by the Minister under this article:-- |
||
(a) the Minister may at any time revoke the appointment, |
||
(b) the person appointed may resign on giving to the Minister one month's notice of his intention to do so. |
||
(3) A person appointed under this article may receive and deal with, on behalf of the claimant or beneficiary, so much of the benefit or pension as is payable by virtue of section 26 or section 27 of the Act or so much of the injury benefit or disablement pension as is payable by virtue of section 10 or section 11 of the Social Welfare (Occupational Injuries) Act, 1966 and the receipt of such person shall be a good discharge to the Minister and to the Social Insurance Fund and the Occupational Injuries Fund, as the case may be, for any sums paid to such person on behalf of the claimant or beneficiary.". |

EXPLANATORY NOTE. |
||
Increases of benefit or pension payable under the Social Welfare Acts, 1952 to 1972, or under the Social Welfare (Occupational Injuries) Act, 1966 , in respect of an adult or child dependent are an integral part of the benefit or pension and are payable to the person so entitled. These Regulations, however, provide that where it appears to the Minister the circumstances so warrant he may appoint a person to receive or deal with the amount of the increases on behalf of the claimant or beneficiary. |
