SOCIAL WELFARE (CONTRIBUTIONS) (AMENDMENT) REGULATIONS, 1973.

SOCIAL WELFARE (CONTRIBUTIONS) (AMENDMENT) REGULATIONS, 1973.

The Minister for Social Welfare, in exercise of the powers conferred on him by sections 3 , 7 , 8 and 9 of the Social Welfare Act, 1952 (No. 11 of 1952), hereby makes the following Regulations:--

1. (1) These Regulations may be cited as the Social Welfare (Contributions) (Amendment) Regulations, 1973.

(2) The Social Welfare (Contributions) Regulations, 1953 to 1972, and these Regulations may be cited collectively as the Social Welfare (Contributions) Regulations, 1953 to 1973.

2. In these Regulations--

"the Principal Regulations" means the Social Welfare (Contributions) Regulations, 1953 ( S.I. No. 5 of 1953 );

"the Regulations of 1970" means the Social Welfare (Contributions) (Amendment) Regulations, 1970 ( S.I. No. 222 of 1970 );

"the Regulations of 1961" means the Social Welfare (Contributions) (Amendment) Regulations, 1961 ( S.I. No. 139 of 1961 ).

3. Sub-article (2) (inserted therein by the Regulations of 1970) of article 4 of the Principal Regulations is hereby amended by the insertion therein of the words "deserted wife's benefit and" before the words "widow's (contributory) pension" in each place where they occur.

4. Sub-article (2) (inserted therein by the Regulations of 1970) of article 5 of the Principal Regulations is hereby amended by the insertion therein of the words "deserted wife's benefit and" before the words "widow's (contributory) pension".

5. Sub-article (2) of article 10 (C) of the Principal Regulations (inserted therein by the Social Welfare (Contributions) (Amendment) Regulations, 1968 ( S.I. No. 1 of 1968 ) as amended by the Regulations of 1970) is hereby amended by the deletion of the words "to a widow's (contributory) pension only or such pension, retirement pension and an old age (contributory) pension, as the case may be," and the substitution therefor of the words "to widow's (contributory) pension and deserted wife's benefit only or to widow's (contributory) pension, deserted wife's benefit, retirement pension and old age (contributory) pension as the case may be.".

6. Article 14 of the Principal Regulations is hereby amended by the insertion in sub-article (6) (A) (inserted by article 11 of the Regulations of 1970) of the words ", in the case of deserted wife's benefit" after the words "retirement pension".

7. The amount of a contribution, paid in respect of a contribution week commencing on or after the 2nd day of July, 1973, to be returned to an insured person shall be--

( a ) under sub-article (1) of article 13A (inserted by the Regulations of 1961) of the Principal Regulations, in respect of old age (contributory) pension,

(i) in respect of an employment contribution paid under paragraphs 1, 3A, 6 or 7 of the Second Schedule to the Act

(ii) in respect of an employment contribution paid under paragraphs, 2, 2A or 3 of the Second Schedule to the Act

(iii) in respect of a voluntary contribution paid at the rate of one pound and thirty-four pence

£0.58

( b ) under sub-article (1) of article 13D (inserted by the Regulations of 1970) of the Principal Regulations, in respect of retirement pension,

(i) in respect of an employment contribution paid under paragraphs 1, 2, 2A, 3A, 6 or 7 of the Second Schedule to the Act

£0.025

(ii) in respect of an employment contribution paid under paragraph 3 of the Second Schedule to the Act

£0.045

(iii) in respect of a voluntary contribution paid at the rate of one pound and thirty-four pence

£0.21

EXPLANATORY NOTE.

The Social Welfare (Contributions) Regulations, 1953 ( S.I. No. 5 of 1953 ) provide, inter alia, for the reckoning of credited contributions for the purposes of certain benefits including widow's contributory pension and for the reckoning in certain circumstances of contributions which are paid after the due date. These amending Regulations extend these provisions to deserted wife's benefit.

The Social Welfare Act 1973 provides for increased rates of insurance contributions with effect from 2 July, 1973. These Regulations determine the amounts of the increased contributions paid in respect of retirement pension to be returned to a person who entered insurance after the age of fifty-five years and who was not insured before that age under the National Health Insurance Acts, 1911 to 1952. The Regulations also determine the amounts paid in respect of old age (contributory) pension to be returned to a person who had not similarly entered insurance before the age of sixty years.
