HARBOUR RATES (FOYNES HARBOUR) ORDER, 1973.

HARBOUR RATES (FOYNES HARBOUR) ORDER, 1973.

I, PETER BARRY, Minister for Transport and Power, in exercise of the powers conferred on me by section 104 of the Harbours Act, 1946 (No. 9 of 1946), and the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ), and after compliance with section 106 of that Act, hereby order as follows:

1. (1) This Order may be cited as the Harbour Rates (Foynes Harbour) Order, 1973.

(2) This Order shall come into operation on the 27th day of November, 1973.

2. The Harbour Rates (Foynes Harbour) Order, 1955 ( S.I. No. 63 of 1955 ), is hereby amended by--

( a ) the substitution for the First Schedule thereto of the matter contained in Part I of the Schedule to this Order,

( b ) the substitution for the Second Schedule thereto of the matter contained in Part II of the Schedule to this Order, and

( c ) the substitution for the Third Schedule thereto of the matter contained in Part III of the Schedule to this Order.

PART I.

FIRST SCHEDULE.

19. Goods not mentioned in any other reference in this schedule. Per tonne 25p

Rates on Exports shall be the same as rates on Imports, except in the case of goods imported at the Port of Foynes from any port for export to any other port and on which Import Goods Rates have been paid; in such case the export rate will be half the import rate provided:--

( a ) That the Goods are exported in the same form and if imported in packages in the same packages as they arrived.

( b ) That the Goods remain the bona fide sole property of the same person throughout.

( c ) That the export takes place within two months of the date of arrival of the importing vessel.

PART II.

SECOND SCHEDULE.

MAXIMUM TONNAGE RATES.

(1) For every Ton of the admeasurement of every Vessel trading solely in the River Shannon for each time of entering the Port a sum not exceeding 4p
(2) For every Ton of the admeasurement of every Vessel acting only as a tug, towing vessels into or out of or within the limits of the Port a sum not exceeding 2p
(3) For every Ton of the admeasurement of every Vessel not trading solely in the River Shannon but loading or discharging in the Port of Foynes cargo for or from any other port in the River Shannon a sum not exceeding 5p
(4) For every Ton of the admeasurement of every Vessel (except as hereinafter provided) arriving from or departing to any Port outside the River Shannon a sum not exceeding 12p
(5) For every Ton of every Vessel remaining within the limits of Foynes Harbour after the expiration of a period of one week for each week or part thereof in excess of the first week in addition to any other sum payable under the Schedule a sum not exceeding

(a) while undergoing repairs

(b) for any other purpose

The Tonnage of a vessel upon which tonnage rates shall be based and chargeable mentioned at Reference numbers (1) to (5) inclusive of this Schedule shall be the Net Register Tonnage or fifty per cent of the Gross Tonnage of the vessel concerned, whichever is the greater.

The word "week" in Reference Number 5 in this Schedule means any period of 7 consecutive days.

PART III.

THIRD SCHEDULE.

OTHER (MAXIMUM) CHARGES.

For the first 7 days 18p per square yard per week or part of a week
or
4p per tonne per week or part of a week, whichever is the greater
For the second 7 days 23p per square yard per week or part of a week

5p per tonne per week or part of a week whichever is the greater
For any period after the second 7 days 30p per square yard per week or part of a week
or
7p per tonne per week or part of a week, whichever is the greater.

EXPLANATORY NOTE.

The effect of this Order is to revise goods and tonnage rates and other charges at Foynes Harbour.
