SOCIAL WELFARE (OCCUPATIONAL INJURIES) (PRESCRIBED DISEASES) (AMENDMENT) REGULATIONS, 1973.

SOCIAL WELFARE (OCCUPATIONAL INJURIES) (PRESCRIBED DISEASES) (AMENDMENT) REGULATIONS, 1973.

I, BRENDAN CORISH, Minister for Social Welfare, in exercise of the powers conferred on me by section 3 of the Social Welfare Act, 1952 (No. 11 of 1952) and by section 23 of the Social Welfare (Occupational Injuries) Act, 1966 (No. 16 of 1966), hereby make the following regulations:

1. These Regulations may be cited as the Social Welfare (Occupational injuries) (Prescribed Diseases) (Amendment) Regulations, 1973.

2. In these Regulations--

"the Principal Regulations" means the Social Welfare (Occupational Injuries) (Prescribed Diseases) Regulations, 1967 ( S.I. No. 78 of 1967 ):

"Part 1" means Part 1 of the Schedule to the Principal Regulations.

3. The Principal Regulations and these Regulations may be cited together as the Social Welfare (Occupational Injuries) (Prescribed Diseases) Regulations, 1967 and 1973.

4. Part 1 is hereby amended by--

( a ) the substitution for the matter contained in the first and second columns thereof at reference number 13 of the following:

"Toxic halogen derivatives of hydrocarbons of the aliphatic series The use or handling of or exposure to the fumes of, or vapour containing, toxic halogen derivatives of hydrocarbons of the aliphatic series.",

( b ) the deletion of the matter contained in the first and second columns thereof at reference number 18,

( c ) the insertion in the first and second columns thereof after reference number 20 of the following:

"20 (A) Acrylamide monomer

The use or handling of, or exposure to, acrylamide monomer,

20 (B) Chrome or its toxic compounds

All work involving exposure to the risk of poisoning by chrome or its toxic compounds.",

( d ) the substitution for the matter contained in the first and second columns thereof at reference number 32 of the following:

"Disease or injury caused by electro-magnetic or ionising radiations

Exposure to electro-magnetic or ionising radiations.",

( e ) the insertion in the second column thereof at reference number 22 after "infected with anthrax" of, "or loading and unloading, or transport, of merchandise which may have been contaminated by animals or animal carcases infected with anthrax", and

( f ) the insertion in the first and second columns thereof after reference number 41 of the following:

"42. Adeno-carcinoma of the nasal cavity or associated air sinuses.

Attendance for work in or about a building where wooden furniture is manufactured.

43. Infection by brucella abortus

Contact with bovine animals infected by brucella abortus, their carcases or parts thereof or their untreated products, or with laboratory specimens or vaccines of or containing brucella abortus, by reason of employment--

( a ) as a farm worker;

( b ) as a veterinary worker:

( c ) as a slaughterhouse worker;

( d ) as a laboratory worker; or

( e ) in any other work relating to the care, treatment, examination or handling of such animals, carcases or parts thereof, or products.".

EXPLANATORY NOTE.

These Regulations by adding to and modifying the list of prescribed diseases set out in Part 1 of the Schedule to the Social Welfare (Occupational Injuries) (Prescribed Diseases) Regulations, 1967 (1) extend insurance under the Social Welfare (Occupational Injuries) Act, 1966 , in the case of persons insurably employed in certain specified occupations, to adeno-carcinoma of the nasal cavity, infection by brucella abortus, poisoning by chrome and poisoning by acrylamide monomer and (2) broaden the provisions in the original Regulations relating to poisoning by the halogen derivatives of hydrocarbons of the aliphatic series, anthrax infection and radiation diseases.
