S.I. No. 340/1974:

ROAD VEHICLES (REGISTRATION AND LICENSING) (AMENDMENT) REGULATIONS, 1974.

ROAD VEHICLES (REGISTRATION AND LICENSING) (AMENDMENT) REGULATIONS, 1974.

The Minister for Local Government in exercise of the powers conferred on him by sections 6 and 12 of the Roads Act, 1920, and sections 1 and 3 of the Finance (Excise Duties) (Vehicles) Act, 1952 (No. 24 of 1952) hereby makes the following Regulations:--

1. (1) These Regulations may be cited as the Road Vehicles (Registration and Licensing) (Amendment) Regulations, 1974.

(2) These Regulations and the Road Vehicles (Registration and Licensing) Regulations, 1958 to 1969, shall be construed together as one and may be cited together as the Road Vehicles (Registration and Licensing) Regulations, 1958 to 1974.

(3) These Regulations shall come into operation on the 1st day of January 1975.

2. In these Regulations--

"the Principal Regulations" means the Road Vehicles (Registration and Licensing) Regulations, 1958 ( S.I. No. 13 of 1958 ).

3. Sub-article (5) of article 1 of the Principal Regulations is hereby amended by the addition of the following definition--

"'military vehicle' means a vehicle used by the Defence Forces".

4. Article 3 of the Principal Regulations is hereby amended by the insertion after "the amount of duty appropriate to the vehicle," of "including any duty imposed by section 94 of the Finance Act, 1973 (No. 19 of 1973),".

5. Article 18 of the Principal Regulations is hereby amended--

( a ) by the insertion in clause (c) of "(not being a military vehicle)" after "State-owned vehicle," and

( b ) by the addition of the following clause--

"(cc) in the case of a military vehicle--the Department of Defence."

6. Sub-article (3) of article 19 of the Principal Regulations is hereby amended by the insertion after "on the first licensing of the vehicle" of "or in the case of a military vehicle on receipt of an application from a duly authorised officer of the Department of Defence".

7. Article 22 of the Principal Regulations is hereby amended--

( a ) by the insertion in sub-article (1) of "and subject to the provisions of sub-article (4) of this article" after "hereinafter specified",

( b ) by the addition of the following sub-article--

"(4) ( a ) The provisions of Part I of these Regulations other than articles 18, 19 and 20 shall not apply to a military vehicle.

( b ) Where a military vehicle ceases to be used as a military vehicle and is transferred to another Department of State or is sold or otherwise transferred to a person other than another Department of State the provisions of sub-paragraphs (e) and ( f ) of sub-article (2) of this article shall apply as respects such vehicle."

EXPLANATORY NOTE.

These regulations amend the Road Vehicles (Registration and Licensing) Regulations 1958 (No. 13 of 1958) so as to provide that on the first registration of a vehicle the duty imposed by section 94 of the Finance Act 1973 (in addition to the duty otherwise appropriate to the vehicle) shall be paid at the time of application for a licence and that military vehicles will be exempt from the requirements of Part I of the Regulations in so far as the licensing of such vehicles is concerned.
