S.I. No. 359/1974:

HARBOUR RATES (NEW ROSS HARBOUR) ORDER, 1974.

HARBOUR RATES (NEW ROSS HARBOUR) ORDER, 1974.

I, PETER BARRY, Minister for Transport and Power, in exercise of the powers conferred on me by section 104 of the Harbours Act, 1946 (No. 9 of 1946), and the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ), and after due compliance with section 106 of that Act, hereby order as follows:

1. (1) This Order may be cited as the Harbour Rates (New Ross Harbour) Order, 1974.

(2) This Order shall come into operation on the 19th day of December, 1974.

2. The Harbour Rates (New Ross Harbour) Order, 1949 ( S.I. No. 230 of 1949 ), shall have effect as if--

( a ) the following were substituted for Article 3 (2):

"(2) Where the rates fixed under this Order are payable at a metric tonne charge, lesser weights shall be chargeable as follows:--

( a ) any weight not exceeding one half tonne shall count as one half tonne,

( b ) any weight exceeding one half tonne but not exceeding one tonne shall count as one tonne."

( b ) the following were substituted for the First Schedule thereto:

"FIRST SCHEDULE.

( c ) the following were substituted for the Second Schedule thereto:

"SECOND SCHEDULE

MAXIMUM TONNAGE RATES

Tonnage rates on vessels other than those described in paragraphs 2, 3 and 4 below.

(a) On every ton of the net register tonnage or half the gross tonnage whichever is the greater of every vessel discharging or loading in the harbour

(b) On every ton of the net register tonnage or half the gross tonnage whichever is the greater of every vessel entering and leaving the harbour without cargo, or entering and leaving the harbour with the same cargo, or for the purpose of seeking refuge a sum not exceeding

(c) On every ton of the net register tonnage or half the gross tonnage whichever is the greater of every vessel lying up in the harbour after the expiration of 28 days for each succeeding month or part thereof, a sum not exceeding

On every river craft which plies regularly between any points in Waterford harbour and New Ross harbour or within the limits of New Ross harbour either:

(a) per cargo or part cargo laden or discharged in New Ross harbour a sum of:

20p
or

(b) at the option of the owner an annual sum payable yearly in advance on the 1st January of:

On every river craft not included in 2 above per cargo or part cargo laden or discharged in New Ross harbour a sum of:

20p
4.

On every ton of the net register tonnage or half the gross tonnage whichever is the greater of every vessel, barge or lighter constructed in New Ross and exported through the port to any port or place

( d ) the following were substituted for the Third Schedule thereto:

"THIRD SCHEDULE

MAXIMUM TONNAGE RATES

1. For the use of the mobile diesel crane £3·75 per hour
2. For mooring or unmooring ships at Pontoon wharf:

(a) Ships carrying not more than 750 tons

£2·50 per ship

(b) Ships carrying more than 750 tons

For the attendance of Harbour Constable at loading or discharging of hazardous cargoes

£3·00 per hour or so much of the remuneration of the Constable as is attributable to the time spent by him in attendance during the loading or discharging, whichever is the greater sum.
4.

For the provision of fresh water at the Commissioners' wharves

25p per 1,000 gallons, together with any labour charges incurred.
5. Wharfage rates. At the Pontoon Wharf £0·01 per ton of cargo loaded or discharged.
At the Commissioners' permanent wharves 50% of the appropriate goods rate."

( e ) the following were substituted for the Fourth Schedule thereto:

"FOURTH SCHEDULE

OTHER (MAXIMUM) CHARGES

For the use of any wharf, pier, quay or shed for any goods (except round native timber, including pit props for export) for a period exceeding the period authorised by the bye-law of the harbour authority for the time being in force:--

For each week or part thereof after the first week, per ton

EXPLANATORY NOTE.

The effect of this Order is to authorise the New Ross Harbour Commissioners to charge increased goods, tonnage and service rates and other charges at New Ross port.
