HARBOUR RATES (DROGHEDA HARBOUR) ORDER, 1976

HARBOUR RATES (DROGHEDA HARBOUR) ORDER, 1976

I, Peter Barry, Minister for Transport and Power, in exercise of the powers conferred on me by section 104 of the Harbours Act, 1946 (No. 9 of 1946), and the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ), and after due compliance with section 106 of the said Act, hereby order as follows:

1. (1) This Order may be cited as the Harbour Rates (Drogheda Harbour) Order, 1976.

(2) This Order shall come into operation on the 16th day of July, 1976.

2. The Harbour Rates (Drogheda Harbour) Order, 1947 S. R. & O., No. 228 of 1947), shall have effect as if--

(a) the following were substituted for the First Schedule (inserted by the Harbour Rates (Drogheda Harbour) Order, 1970 ( S.I. No. 157 of 1970 ))

1. Tonnage rates on vessels other than vessels described at Paragraphs 2 and 3 below.

(a) On every ton of the net register tonnage or of half the gross tonnage whichever is the greater of every vessel (except as hereinafter provided) entering the Harbour for the purpose of shipping, trans-shipping or discharging cargo, or cargo and passengers, a sum not exceeding

(b) On every ton of the net register tonnage or of half the gross tonnage whichever is the greater of every vessel entering the Harbour for the purpose of embarking of disembarking passengers or on an excursion trip, or through stress of weather, or for repairs, or for salvage operations, or for a supply of stores for ships consumption only and not discharging or loading cargo a sum not exceeding

(c) On every ton of the net register tonnage or of half the gross tonnage whichever is the greater of every vessel remaining or lying in the Harbour after the expiration of a consecutive period of 6 weeks a sum for each week not exceeding

2. Tonnage rates on fishing vessels.

As a composition in full in lieu of tonnage rates on every fishing vessel engaged in fishing entering or leaving the Harbour per trip

3. Tonnage rates on salvage vessels.

The appropriate charges at Reference No. 1 (b) above on first entry to the Harbour and in addition on every ton of the net register tonnage or half the gross tonnage whichever is the greater, with a minimum of 120 rateable tons for each day (Sundays excepted) during the continuance of the salvage operations or in the breaking up or removal of wrecks a sum not exceeding

3. Article 2 of the Harbour Rates (Drogheda Harbour) Order, 1974 ( S.I. No. 330 of 1974 ), is hereby revoked.

This Order authorises Drogheda Harbour Commissioners to charge revised goods and tonnage rates at Drogheda Harbour.
