I, CONOR CRUISE O'BRIEN, Minister for Posts and Telegraphs, in exercise of the powers conferred on me by Section 2 of the Telegraph Act, 1885, and with the consent of the Minister for Finance, hereby make the regulations contained in the following Warrant: -- |
||||||||||||||
1. (1) This Warrant may be cited as the Telegraph (Inland Written Telegram) Amendment (No. 16) Warrant, 1977. |
||||||||||||||
(2) This Warrant shall come into operation on the 1st day of April, 1977. |
||||||||||||||
2. In this Warrant-- |
||||||||||||||
"the 1920 Regulations" means the Telegraph (Inland Written Telegram) Regulations, 1920; |
||||||||||||||
"the 1955 Warrant" means the Telegraph (Inland Written Telegram) Amendment (No. 6) Warrant, 1955 ( S.I. No. 144 of 1955 ); |
||||||||||||||
"the 1975 Warrant" means the Telegraph (Inland Written Telegram) Amendment (No. 15) Warrant, 1975 ( S.I. No. 312 of 1975 ). |
||||||||||||||
3. (1) The 1920 Regulations are hereby amended by-- |
||||||||||||||
(a) the substitution of the following for paragraph (1) of Regulation 7: |
||||||||||||||
"7.--(1) Subject to the provisions of these Regulations, there shall be charged and paid for the delivery of a Telegram by a special messenger at an address beyond the limits of free delivery the sum of 8½p for any distance less than sixteen hundred metres or part of sixteen hundred metres over and above any complete multiple of sixteen hundred metres, from the boundary of the free delivery area."; |

(b) the substitution of the following for Regulation 20 (inserted by Regulation 3 (1) (b) of the 1975 Warrant): |
||||||||||||||
"20.--A Telegram may, at the request of the sender, be delivered at several addresses within the limits of the free delivery of the Terminal Telegraph Office, and in such case 8½p shall be charged and paid for the delivery of the telegram at each address after the first. Accordingly if, for example, a telegram contained a message of ten words of text and the following addresses (which contain twelve words):-- |

the telegram should be charged for as follows:-- |

||||||||||||||
(c) the substitution in Regulation 27 (1) for "7p" (inserted by Regulation 3 (1) (c) of the 1975 Warrant) of "8p"; |
||||||||||||||
(d) the substitution in Regulation 32 (2), as amended by Regulation 13 of the 1955 Warrant, for references to "56p" and "63p" (inserted by Regulation 3 (1) (d) of the 1975 Warrant) of references to "70p" and "78p" respectively; |
||||||||||||||
(e) the substitution in subparagraph (c) of paragraph (2) of Regulation 33 for "£7.00" (inserted by Regulation 3 (1) (e) of the 1975 Warrant) of "£8.75"; |
||||||||||||||
(f) the substitution in Regulation 34 (2) (a) for "17p", "35p", "sum of £3.00" and "£3.00 per annum "(inserted by Regulation 3 (1) (f) of the 1975 Warrant) of "21p", "43p", "sum of £3.75" and "£3.75 per annum", respectively; |
||||||||||||||
(g) the substitution in Regulation 34 (2) (b) for "70p" (inserted by Regulation 3 (1) (g) of the 1975 Warrant) of "87½p". |
||||||||||||||
(2) Regulations 7 (1), 20, 27 (1), 32 (2) (c), 34 (2) (a) and 34 (2) (b) of the 1920 Regulations, as amended by paragraph (1) of this Regulation, are set out in paragraphs (1), (2), (3), (4), (5) and (6), respectively, of the Table of this Warrant. |

4. (1) The 1955 Warrant is hereby amended by-- |
||||||||||||||
(a) the substitution in Regulation 4 (a) for "70p" (inserted by Regulation 4 (1) (a) of the 1975 Warrant) of "87p"; |
||||||||||||||
(b) the substitution in Regulation 4 (b) for "70p" and "5p" (both inserted by Regulation 4 (1) (b) of the 1975 Warrant) of "87p" and "6p", respectively; |
||||||||||||||
(c) the substitution in Regulation 5 (a) for "75p" (inserted by Regulation 4 (1) (c) of the 1975 Warrant) of "93p"; |
||||||||||||||
(d) the substitution in Regulation 5 (b) for "75p" and "7p" (both inserted by Regulation 4 (1) (d) of the 1975 Warrant) of "93p" and "9p", respectively; |
||||||||||||||
(e) the substitution in Regulation 6 for "10½p" (inserted by Regulation 4 (1) (e) of the 1975 Warrant) of "13p"; |
||||||||||||||
(f) the substitution in Regulation 7 (1) (a) for "70p" (inserted by Regulation 4 (1) (f) of the 1975 Warrant) of "87p"; |
||||||||||||||
(g) the substitution in Regulation 7 (1) (b) for "75p" (inserted by Regulation 4 (1) (g) of the 1975 Warrant) of "93p"; |
||||||||||||||
(h) the substitution in Regulation 7 (6) (a) for "5p" (inserted by Regulation 4 (1) (h) of the 1975 Warrant) of "6p"; |
||||||||||||||
(i) the substitution in Regulation 9 (1) (a) for "17½p" (inserted by Regulation 4 (1) (i) of the 1975 Warrant) of "21p"; |
||||||||||||||
(j) the substitution in Regulation 9 (1) (b) for "17½p" and "3p" (both inserted by Regulation 4 (1) (j) of the 1975 Warrant) of "21p" and "3½p", respectively; |
||||||||||||||
(k) the substitution in Regulation 10 (a) for "70p" and "£1.35" (both inserted by Regulation 4 (1) (k) of the 1975 Warrant) of "87p" and "£1.65", respectively; |
||||||||||||||
(l) the substitution in Regulation 10 (b) for "£1.40" and "£2.30" (both inserted by Regulation 4 (1) (l) of the 1975 Warrant) of "£1.78" and "£2.76", respectively; |
||||||||||||||
(m) the substitution in Regulation 16 for "56p" in both places where that amount is mentioned (having been inserted by Regulation 4 (1) (m) of the 1975 Warrant) of "70p". |
||||||||||||||
(2) Regulations 4, 5, 6, 7 (1), 7 (6) (a), 9 (1), 10 and 16 of the 1955 Warrant, as amended by paragraph (1) of this Regulation, are set out in paragraphs (7), (8), (9), (10), (11), (12), (13) and (14), respectively, of the Table to this Warrant. |

(1) 7.--(1) Subject to the provisions of these Regulations there shall be charged and paid for the delivery of a Telegram by a special messenger at an address beyond the limits of free delivery the sum of 8½p for any distance less than sixteen hundred metres, or for each sixteen hundred metres or part of sixteen hundred metres over and above any complete multiple of sixteen hundred metres from the boundary of the free delivery area. |

(2) 20.--A telegram may, at the request of the sender, be delivered at several addresses within the limits of the free delivery of the Terminal Telegraph Office, and in such case 8½p shall be charged and paid for the delivery of the telegram at each address after the first. Accordingly if, for example, a telegram contained a message of ten words of text and the following addresses (which contain twelve words): |

the telegram shall be charged for as follows: |
||||||||||||||

||||||||||||||
(3) 27.--The sender of a telegram may cancel it before delivery to the addressee, subject to the following provisions:-- |
||||||||||||||
(1) If the application for cancellation be made before the transmission of the telegram from the office of origin has commenced, the sum prepaid for transmission less the sum of 8p, together with any sum prepaid for delivery, shall be returned. |
||||||||||||||
(4) 32.--(1) Telegrams may at the request of the sender or addressee be re-diverted and re-transmitted by telegraph. |
||||||||||||||
(2) There shall be charged and paid in respect of each re-transmission the same charges as would be payable on the original transmission of the telegram to the second address. Provided that when the Postmaster-General deems it just so to do he may substitute a fixed charge of 70p in respect of a telegram within the State or of 78p in respect of a telegram to a place within the British Telegraph Administration for all other charges for re-direction and re-transmission. |

(5) 33.--(2) (a) Application may be made for the registration, at any office from which telegrams are delivered (provided it be a head office, a country sub-office or a railway station not in a town postal district) of an abbreviated or an arbitrary address. |
||||||||||||||
(b) If in the opinion of the Postmaster-General there is no objection to such registration, such abbreviated or arbitrary address shall be registered, together with the full or correct address of the applicant. |
||||||||||||||
(c) There shall be paid for such registration such yearly sum (not exceeding £8.75, and hereinafter called a registration fee) as the Postmaster-General may from time to time prescribe and such registration fee shall be paid in advance. |
||||||||||||||
(6) 34.--(1) Any person may register at any Telegraph Office special instructions as to the delivery of Telegrams at a different address in case of a change of residence or place of business or such other special instructions as to the delivery of Telegrams as the Postmaster-General may approve, and Telegrams shall be delivered in accordance with such instructions subject to the charges mentioned in this Regulation and to the charges prescribed by these Regulations for the re-transmission of re-directed telegrams. |
||||||||||||||
(2) (a) In respect of special instructions in the case of a change of residence or place of business, the sum of 21p shall be paid in advance at the time of registration if such instructions are not applicable to a longer period than one week, and the sum of 43p if the instructions are not applicable to a longer period than one month. In all other cases in which such instructions are registered the sum of £3.75 shall be paid in advance at the time of registration, and when such instructions are applicable to a longer period than a year the sum payable shall be £3.75 per annum. |

(b) In respect of other special instructions as to the delivery of telegrams the sum of 87½p shall be paid in advance at the time of registration. |
||||||||||||||
(7) 4.--Subject to the provisions of this Warrant, there shall be charged and paid for the transmission of a telegram, other than an overnight telegram, within the State:-- |
||||||||||||||
(a) if the length of the telegram does not exceed twelve words, 87p; |
||||||||||||||
(b) if the length of the telegram exceeds twelve words, 87p for the first twelve words and 6p for each additional word. |
||||||||||||||
(8) 5.--Subject to the provisions of this Warrant, there shall be charged and paid for the transmission of a telegram addressed to a place within the British Telegraph Administration: |
||||||||||||||
(a) if the length of the telegram does not exceed twelve words, 93p; |
||||||||||||||
(b) it the length of the telegram exceeds twelve words, 93p for the first twelve words and 9p for each additional word. |
||||||||||||||
(9) 6.--In respect of a telegram tendered on Sunday, Good Friday or a public holiday, there shall be charged and paid 13p in addition to the amount payable under Regulation 4 or Regulation 5 (as may be appropriate) of this Warrant. |
||||||||||||||
(10) 7.--(1) Subject to the conditions specified in paragraph (2) of this Regulation being satisfied, there shall be charged and paid for a telegram addressed to a newspaper, newsagency, newsroom, club or exchange room and containing matter intended for publication as news (excluding (i) letters to the editor of a newspaper and (ii) advertisements, notices and articles which are not normally published without charge)-- |
||||||||||||||
(a) for a telegram within the State, for each 60 words or part thereof, 87p; |
||||||||||||||
(b) for a telegram addressed to a place within the British Telegraph Administration, for each 60 words or part thereof, 93p. |
||||||||||||||
(11) 7.--(6) (a) A telegram transmitted under this Regulation may at the request of the sender be delivered at several addresses within the limit of the free delivery of the terminal telegraph office. In such cases there shall be charged and paid for the delivery of the telegram at each address after the first the sum of 6p for each 60 words or part thereof. Subject to the foregoing provision of this subparagraph each transmission of the telegram to a separate address shall be charged for as the transmission of a separate telegram. |
||||||||||||||
(12) 9.--(1) Subject to the provisions of this Warrant, there shall be charged and paid for the transmission of an overnight telegram: |
||||||||||||||
(a ) if the length of the telegram does not exceed twelve words, 21p; |
||||||||||||||
(b) if the length of the telegram exceeds twelve words, 21p for the first twelve words and 3½ p for each additional word. |
||||||||||||||
(13) 10.--The sender of a telegram may pay for the transmission of a reply thereto at the appropriate rate or rates, but the sum so paid shall not-- |
||||||||||||||
(a) in the case of a telegram within the State, be less than 87p or exceed £1.65p, and |
||||||||||||||
(b) in the case of a telegram to a place within the British Telegraph Administration, be less than £1.78 or exceed £2.76. |
||||||||||||||
(14) 16.--There shall be charged and paid for a telegram applying for a withdrawal from the Post Office Savings Bank, Dublin, 70p, and for the reply telegram authorising the withdrawal from the Savings Bank, 70p. |
