UNDERSIZED SEA-FISH ORDER, 1978.

UNDERSIZED SEA-FISH ORDER, 1978.

I, BRIAN LENIHAN, Minister for Fisheries, in exercise of the powers conferred on me by sections 225 and 230 of the Fisheries (Consolidation) Act, 1959 (No. 14 of 1959), and the Fisheries (Transfer of Departmental Administration and Ministerial Functions) Order, 1977 ( S.I. No. 30 of 1977 ) (as adapted by the Lands (Alteration of Name of Department and Title of Minister) Order, 1977 ( S.I. No. 29 of 1977 )), hereby order as follows:

1. This Order may be cited as the Undersized Sea-Fish Order, 1978.

2. This Order shall come into operation on the 10th day of July, 1978.

3. (1) Each kind of sea-fish mentioned in the column (2) of the Schedule hereto which, when measured in the manner directed by paragraph (2) of this Article, is less in length than that specified in the column (3) of the said Schedule opposite the mention, in the said column (2) of such kind of sea-fish shall, for the purposes of Chapter III of Part XIII of the Fisheries (Consolidation) Act, 1959 (No. 14 of 1959), be undersized.

(2) The length of each kind of sea-fish shall, for the purposes of this Article, be measured between the tip of the snout and the end of the tail fin, or, if any portion of the snout or of the tail fin has been removed between the ends of the remaining portion of the snout and of the remaining portion of the tail fin.

4. The Undersized Sea-Fish Order, 1976 ( S.I. No. 109 of 1976 ), is hereby revoked.

EXPLANATORY NOTE.

This Order supercedes the Undersized Sea-Fish Order, 1976. It repeats the provisions of that Order but decreases the minimum length for Haddock to 27 centimetres, for Witches to 28 centimetres, for Whiting to 23 centimetres and for Dabs to 15 centimetres.
