DISTRICT COURT AREAS (VARIATION OF DAYS AND HOURS) (NO. 5) ORDER, 1978.

DISTRICT COURT AREAS (VARIATION OF DAYS AND HOURS) (NO. 5) ORDER, 1978.

I, GERARD COLLINS, Minister for Justice, in exercise of the powers conferred on me by section 26 (1) of the Courts of Justice Act, 1953 (No. 32 of 1953), and after consultation with the President of the District Court, hereby order as follows:

1. (1) This Order may be cited as the District Court Areas (Variation of Days and Hours) (No. 5) Order, 1978.

(2) This Order shall come into operation on the 1st day of December, 1978.

2. In this Order--

"the Order of 1966" means the District Court Areas (Variation of Hours) Order, 1966 ( S.I. No. 213 of 1966 );

"the Principal Order" means the District Court (Areas) Order, 1961 ( S.I. No. 5 of 1961 ).

3. The days and hours for holding the District Court in the district court area of Annascaul shall, in lieu of the days and hours (as amended by the Order of 1966) specified in column (4) at reference number 104 in the First Schedule to the Principal Order, be the third Friday in February, April, June, October and December at 11.00 a.m. and the third Friday in September at 3.00 p.m.

4. The days and hours for holding the District Court in the district court area of Castlegregory shall, in lieu of the days and hours (as amended by the Order of 1966) specified in column (4) at reference number 107 in the First Schedule to the Principal Order, be the third Friday in January, March, May, July, September and November at 11 a.m.

5. The days and hours for holding the District Court in the district court area of Causeway shall, in lieu of the days and hours (as amended by the Order of 1966) specified in column (4) at reference number 109 in the First Schedule to the Principal Order, be the second Friday in January, March, May, July, September and November at 11.00 a.m.

6. The days and hours for holding the District Court in the district court area of Dingle shall, in lieu of the days and hours (as amended by the Order of 1966) specified in column (4) at reference number 110 in the First Schedule to, and in column (4) at reference number 95 in the Second Schedule to, the Principal Order, be the fourth Friday in each month at 11.00 a.m.

7. The days and hours for holding the District Court in the district court area of Kenmare shall, in lieu of the days and hours specified in column (4) at reference number 111 in the First Schedule to, and in column (4) at reference number 96 in the Second Schedule to, the Principal Order, be the first Friday in each month at 11.00 a.m.

8. The days and hours for holding the District Court in the district court area of Tralee shall, in lieu of the days and hours specified in column (4) at reference number 118 in the First Schedule to the Principal Order, be each Wednesday at 11.00 a.m. and shall, in lieu of the days and hours specified in column (4) at reference number 103 in the Second Schedule to the Principal Order, be the first and third Wednesday in each month at 11.00 a.m.

9. Business transacted in the District Court which is initiated and is not completed before the commencement of this Order shall be continued and completed as if this Order has been in force at the time at which such business had been initiated.

EXPLANATORY NOTE.

This Order alters the existing provisions with regard to the days for holding sittings of the District Court in Annascaul, Castlegregory, Causeway, Dingle, Kenmare and Tralee.
