INDUSTRIAL RESEARCH AND STANDARDS (SECTION 44) (CHILDREN'S NIGHTWEAR) ORDER, 1979. |

I, DESMOND O'MALLEY, Minister for Industry, Commerce and Energy, in exercise of the powers conferred on me by section 44 of the Industrial Research and Standards Act, 1961 (No. 20 of 1961), hereby make the following Order: |
||
1. This Order may be cited as the Industrial Research and Standards (Section 44) (Children's Nightwear) Order, 1979, and shall come into operation on the 5th day of January, 1979. |
||
2. In this Order-- |
||
"child's nightwear" means a child's dressing-gown, a child's nightdress or a child's pyjamas; |
||
"child's dressing gown" means a dressing-gown which has a finished garment chest measurement not exceeding 97 centimetres and an under arm sleeve measurement not exceeding 43 centimetres; |
||
"child's nightdress" means a nightdress which-- |
||
( a ) has a finished garment chest measurement not exceeding 97 centimetres, |
||
( b ) is of a length which, measured from the highest point of the shoulder to the bottom of the garment, does not exceed 117 centimetres, and |
||
( c ) is not so made or designed as to be unsuitable to be worn by a person under the age of 13 years; |
||
"child's pyjamas" means pyjamas the jacket of which has a finished garment chest measurement not exceeding 97 centimetres and the trousers of which have an inside leg measurement not exceeding 76 centimetres; |
||
"finished garment chest measurement" means twice the measurement of the garment across the chest when the garment is laid out as flat as possible without distorting its natural two-dimensional shape and, where appropriate, buttoned or otherwise fastened as it is designed to be in normal wear. |

3. It shall be unlawful to manufacture, assemble or sell children's nightwear unless it complies with the following conditions-- |
||
( a ) it is not treated with the substance or chemical known as tris (2, 3-dibromopropyl) phosphate: |
||
( b ) it is not made from fabric treated with that substance, and |
||
( c ) it is not made from fabric containing fibre containing that substance. |
||

EXPLANATORY NOTE. |
||
The purpose of this Order is to prohibit the manufacture, assembly, or sale of "Tris" treated children's nightwear because of potential health hazard. |
