FUELS (CONTROL OF SUPPLIES) (REGULATION AND CONTROL OF SUPPLY AND DISTRIBUTION OF LIQUIFIED PETROLEUM GAS) ORDER, 1980.

FUELS (CONTROL OF SUPPLIES) (REGULATION AND CONTROL OF SUPPLY AND DISTRIBUTION OF LIQUIFIED PETROLEUM GAS) ORDER, 1980.

WHEREAS there is for the time being in force an order entitled the Petroleum Oils (Control of Supply and Distribution Order 1979 ( S.I. No. 140 of 1979 ) made under Section 2 of the Fuels (Control of Supplies) Act, 1971 (No. 3 of 1971);

NOW, I, GEORGE COLLEY, Minister for Energy, in exercise of the powers conferred on me by Section 3 of the Fuels (Control of Supplies) Act, 1971 , hereby order as follows:--

1. This Order may be cited as the Fuels (Control of Supplies) (Regulation and Control of Supply and Distribution of Liquified Petroleum Gas) Order, 1980.

2. In this Order--

"cylinder" means a pressure vessel with a test pressure of 370 lbs. per square inch, but does not include small cylinders of LPG intended for use with picnic-stoves and similar appliances;

"full" means containing approximately 25 lbs. of LPG; "LPG" means liquified petroleum gas;

"trader" means a person engaged in the sale of LPG in cylinders.

3. A trader shall not sell or otherwise dispose of to another person (other than his supplier or another trader) a full cylinder of LPG, unless at the time of the transaction the trader receives from the purchaser another LPG cylinder and retains for collection by, or transmission to, his supplier the cylinder so received.

4. The prohibition imposed by paragraph 3 of this Order shall not apply to a transaction made in conjunction with, and at the same time as, the purchase from a trader of an LPG cooker incorporating an oven or of an LPG appliance specifically designed for space heating.

5. The prohibition imposed by paragraph 3 of this Order shall not apply to sales of cylinders for industrial, medical, educational or scientific purposes provided the purchaser is known to the trader as a person requiring L.P.G. for an aforementioned purpose.

EXPLANATORY NOTE.

This Order prohibits, save in exceptional specified circumstances, a trader from selling or disposing of a full cylinder of liquified petroleum gas unless he receives another cylinder in exchange for return to the supplier.
