DUBLIN DISTRICT MILK BOARD (LEVY) (AMENDMENT) REGULATIONS, 1981.

I, ALAN DUKES, Minister for Agriculture, in exercise of the powers conferred on me by section 4 of the Milk (Regulation of Supply and Price) Act, 1936 ( No. 43 of 1936 ), and section 41 (as amended by section 19 of the Milk (Regulation of Supply and Price) (Amendment) Act, 1941 ( No. 11 of 1941 ), and section 7 of the Milk (Regulation of Supply and Price) (Amendment) Act, 1952 ( No. 9 of 1952 )) of that Act, as adapted by the Agriculture (Alteration of Name of Department and Title of Minister) Order, 1977 ( S.I. No. 31 of 1977 ), hereby make the following regulations:

1. These Regulations may be cited as the Dublin District Milk Board (Levy) (Amendment) Regulations, 1981.

2. In these Regulations--

“the Board” means the Dublin District Milk Board;

“the section” means section 41 of the Milk (Regulation of Supply and Price) Act, 1936 ( No. 43 of 1936 ), as amended by section 19 of the Milk (Regulation of Supply and Price) (Amendment) Act, 1941 ( No. 11 of 1941 ), and section 7 of the Milk (Regulation of Supply and Price) (Amendment) Act, 1952 ( No.9 of 1952 ).

3. The Interpretation Act, 1937 (No. 38 of 1937) , applies to these Regulations.

4. (1) For the purposes of the levy payable to the Board under subsection (1) (b) of the section--

(a) the prescribed sum shall, in respect of the month of October 1981, and each subsequent month be 0.862 new pence;

(b) regulation 4(1) (a) of the Dublin District Milk Board (Levy) (Amendment) Regulations, 1971 ( S.I. No. 16 of 1971 ), shall not apply in relation to any such month.

(2) For the purposes of the levy payable to the Board under subsection 2 (b) of the section--

(a) the prescribed sum shall, in respect of the month of October 1981, and each subsequent month be 0.862 new pence;

(b) regulation 4 (2) (a) of the Regulations mentioned in paragraph (1) (b) shall not apply in relation to any such month.

5. The Dublin District Milk Board (Levy) (Amendment) Regulations ( S.I. No. 107 of 1973 ), are hereby revoked as on and from the 1st day of October 1981.
