TELEX (AMENDMENT) (NO. 3) REGULATIONS, 1981.

I, PATRICK COONEY, Minister for Posts and Telegraphs, in exercise of the powers conferred on me by section 2 of the Telegraph Act, 1885, hereby make the following Regulations:

1. (1) These Regulations may be cited as the Telex (Amendment) (No. 3) Regulations, 1981.

(2) The collective citation “the Telex Regulations, 1980 and 1981,” shall include these Regulations.

2. These Regulations shall come into operation on the 1st day of December, 1981.

3. The Interpretation Act, 1937 (No. 38 of 1937) , applies to these Regulations.

4. The Telex Regulations, 1980 ( S.I. No. 197 of 1980 ), are hereby amended by the substitution of the following regulation for Regulation 23:

“23. (1) Any notice which may be given by the Minister under an agreement or these Regulations shall be deemed to have been duly given to a subscriber if--

(a) the notice is left at the subscribers premises or is sent to him by ordinary post at the address specified as his in the agreement, or

(b) the notice is addressed to subscribers generally and is published in the Iris Oifigiúil and also in each of the morning daily newspapers published in the State.

(2) Any account which may be rendered by the Minister under an agreement or these Regulations shall be deemed to have been duly rendered to a subscriber if a copy of the account is left at the subscriber's premises or is sent to him by ordinary post at the address specified as his in the agreement.”

The purpose of these Regulations is to provide for the abolition of the obligation to notify subscribers individually by post of revision in telex charges and to provide in lieu for notification by newspaper advertisement.
