HARBOUR RATES (CAPPA PIER AT KILRUSH) ORDER, 1983.

I, JIM MITCHELL, Minister for Transport, in exercise of the powers conferred on me by section 104 of the Harbours Act, 1946 (No. 9 of 1946), the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ), and the Tourism and Transport (Alteration of Name of Department and Title of Minister) Order, 1980 ( S.I. No. 11 of 1980 ), and after due compliance with section 106 of the said Act, hereby order as follows:

1. (1) This Order may be cited as the Harbour Rates (Cappa Pier at Kilrush) Order, 1983.

(2) This Order shall come into operation on the 5th day of August, 1983.

2. (1) The rates set out in the Schedules to this Order are hereby fixed as the maximum rates to be charged by the Kilrush Urban District Council in respect of Cappa Pier at Kilrush.

(2) Where rates fixed under this Order are payable at a metric tonne charge, lesser weights shall be chargeable as follows:--

( a ) any weight not exceeding 250 kilogrammes shall count as 250 kilogrammes,

( b ) any weight exceeding 250 kilogrammes but not exceeding 500 kilogrammes shall count as 500 kilogrammes,

( c ) any weight exceeding 500 kilogrammes but not exceeding 750 kilogrammes shall count as 750 kilogrammes,

( d ) any weight exceeding 750 kilogrammes but not exceeding 1 tonne, shall count as 1 tonne.

3. The Harbour Rates (Cappa Pier at Kilrush) Order, 1981 ( S.I. No. 221 of 1981 ), is hereby revoked.

EXPLANATORY NOTE
