BOVINE TUBERCULOSIS (ATTESTATION OF THE STATE AND GENERAL PROVISIONS) (AMENDMENT) ORDER, 1983. |
||
I, AUSTIN DEASY, Minister for Agriculture, in exercise of the powers conferred on me by sections 3 and 13 of the Diseases of Animals Act, 1966 (No. 6 of 1966), as adapted by the Agriculture and Fisheries (Alteration of Name of Department and Title of Minister) Order, 1977 ( S.I. No. 31 of 1977 ), hereby order as follows:-- |

1. (1) This Order may be cited as the Bovine Tuberculosis (Attestation of the State and General Provisions) (Amendment) Order, 1983. |
||
(2) The Bovine Tuberculosis (Attestation of the State and General Provisions) Orders, 1978 and 1982, and this Order may be cited together as the Bovine Tuberculosis (Attestation of the State and General Provisions) Orders, 1978 to 1983. |
||
(3) This Order shall come into operation on the 15th day of August, 1983. |
||
2. The Bovine Tuberculosis (Attestation of the State and General Provisions) Order, 1978 ( S.I. No. 256 of 1978 ), is hereby amended by-- |
||
( a ) the insertion in Article 2, after the definition of "authorised officer" of the following definition: |
||
" 'the Calf Premium Scheme' means the calf premium scheme operated by the Department of Agriculture;"; |
||
( b ) the substitution of the following subparagraph for subparagraph (b) of Article 17 (4), inserted by Article 2 of the Bovine Tuberculosis (Attestation of the State and General Provisions) (Amendment) Order, 1982 ( S.I. No. 176 of 1982 ): |
||
"( b ) it bears on its right ear an ear-tag issued for the purposes of the Calf Premium Scheme and applied by the herdowner into whose herd the animal was born and is accompanied by a birth certificate which was supplied by the Department of Agriculture and completed in accordance with the provisions of the Calf Premium Scheme and which relates to the animal."; |
||
( c ) the substitution of the following paragraph for paragraph (3) of Article 23: |
||
"(3) Animals of the following classes only may be exposed at a sale to which this Article applies-- |
||
( a ) free animals in respect of which there are identity cards showing that the animals have passed a test within the period of thirty days ending on the date of the sale and to the left ear of which are still attached the ear-tags attached in pursuance of this Order, |
||
( b ) free animals six weeks of age or under which-- |
||
(i) both bear an approved ear-tag on their left ear and are accompanied by an identity card issued by the Minister in respect of the particular animal concerned, or |
||
(ii) both bear on their right ear an ear-tag issued for the purposes of the Calf Premium Scheme and applied by the herdowner into whose herd the particular animal concerned was born and are accompanied by a birth certificate which was supplied by the Department of Agriculture and completed in accordance with the provisions of the Calf Premium Scheme and which relates to such particular animal."; and |
||
( d ) the substitution of "a document" and "left or right ear as may be appropriate," for "the document" and "left ear", respectively, in paragraph (5) of Article 23; |
||
and the said paragraph (5), as so amended, is set out in the Table to this Regulation. |

(5) The owner, or the person in charge of a sale to which this Article applies shall ensure that any animal which is required by this Order or by the Diseases of Animals Act, 1966 , to be accompanied by a document specified in paragraph (3) of this Article is not accepted for sale on the premises where such sale is to take place unless it is accompanied by such document and has still attached to its left or right ear, as may be appropriate, the ear-tag attached in pursuance of this Order. |

EXPLANATORY NOTE. |
||
This Order brings the Regulations on the movement of calves into line with revised procedures in operation under the Calf Premium Scheme operated by the Department of Agriculture. |
