ENVIRONMENT (DELEGATION OF FUNCTIONS) ORDER, 1983.

ENVIRONMENT (DELEGATION OF FUNCTIONS) ORDER, 1983.

The Government, on the request of the Minister for the Environment and in exercise of the powers conferred on them by section 2 (1) of the Ministers and Secretaries (Amendment) (No. 2) Act, 1977 (No. 28 of 1977), hereby order as follows:

1. This Order may be cited as the Environment (Delegation of Functions) Order, 1983.

2. The following powers and duties of the Minister for the Environment (in this Article subsequently referred to as "the Minister") are hereby delegated to Ruairi Quinn, Minister of State at the Department of the Environment, namely,

(a) the powers and duties of the Minister under each of the enactments and the instrument specified in the Schedule to this Order and under any instrument under any such enactment,

(b) the powers and duties of the Minister under the provisions of the Towns Improvement Clauses act, 1847, and the Commissioners Clauses Act, 1847, incorporated with and forming part of the Towns Improvement (Ireland) Act, 1854, by virtue of section 57 of the last-mentioned Act insofar as they apply to bye-laws under section 88 thereof,

(c) the powers and duties of the Minister under section 221 of the Public Health (Ireland) Act, 1878, insofar as they apply to bye-laws under section 92 or 101 of the Road Traffic Act, 1961 (No. 24 of 1961),

(d) the powers and duties of the Minister under Section 68 of the Local Government Act, 1925 (No. 5 of 1925), insofar as, by virtue of section 10 of the Water Supplies Act, 1942 (No. 1 of 1942), they apply with modification to the confirmation of provisional orders under the last-mentioned Act,

(e) the powers of the Minister in relation to directions under section 158 (3) of the Road Traffic Act, 1933 (No. 11 of 1933).

(f) The powers and duties of the Minister under--

(i) section 5 of the Road Traffic Act, 1961 (No. 24 of 1961), insofar as they relate to the making of regulations under section 46 of the last-mentioned Act, and

(ii) section 6 of the last-mentioned Act, and,

(g) the powers and duties of the Minister under section 76 and the Third Schedule to the Housing Act, 1966 (No. 21 of 1966), (including those powers and duties as applied to decisions of a local authority under subsection (1) or (2) of section 10 (inserted by Section 86 of the Housing Act, 1966 ) of the Local Government (No. 2) Act, 1960 (No. 40 of 1960)).
