EUROPEAN COMMUNITIES (PROHIBITION OF IMPORTATION OF SKINS OF CERTAIN SEAL PUPS AND RELATED PRODUCTS) REGULATIONS, 1983.

EUROPEAN COMMUNITIES (PROHIBITION OF IMPORTATION OF SKINS OF CERTAIN SEAL PUPS AND RELATED PRODUCTS) REGULATIONS, 1983.

I, PADDY O'TOOLE, Minister for Fisheries and Forestry, in exercise of the powers conferred on me by section 3 (2) of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Council Directive 83/129/EEC of 28 March 1983(1), hereby make the following Regulations:

1. (1) These Regulations may be cited as the European Communities (Prohibition of Importation of Skins of Certain Seal Pups and Related Products) Regulations, 1983.

(2) These Regulations shall come into operation on the 1st day of October 1983.

2. (1) In these Regulations "the Council Directive" means Council Directive 83/129/EEC of 28 March 1983.

(2) A word or expression that is used in these Regulations and is also used in the Council Directive has, unless the contrary intention appears, the meaning in these Regulations that it has in the Council Directive.

3. A person shall not import commercially into the State a product to which the Council Directive applies.

4. A person who contravenes Regulation 3 of these Regulations shall be guilty of an offence and shall, without prejudice to any penalty to which he may be liable under the Customs Acts, be liable on summary conviction to a fine not exceeding £500.

EXPLANATORY NOTE.

These Regulations give effect to EEC Council Directive No. 83/129 (O.J. No. L91/30 of 9 April 1983) and make it an offence to import commercially furskins of whitecoat pups of harp seals and of pups of hooded seals (blue-backs).

The maximum fine for an offence, on summary conviction, is £500 in addition to any penalty to which an offender may be liable under the Customs Acts.
