EUROPEAN COMMUNITIES (JEWELLERY) REGULATIONS, 1984.

I, JOHN BRUTON, Minister for Industry, Trade, Commerce and Tourism, in exercise of the power conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of enabling Article 30 of the EEC Treaty to have full effect as regards the goods to which the orders revoked by the following Regulations apply, hereby make the following Regulations:

1. (1) These Regulations may be cited as the European Communities (Jewellery) Regulations, 1984.

(2) These Regulations shall come into operation on the 1st day of February, 1984.

2. (1) The Merchandise Marks (Restriction on Sale of Imported Jewellery) Order, 1971 ( S.I. No. 306 of 1971 ), is hereby revoked.

(2) The Merchandise Marks (Restriction on Importation of Jewellery) Order, 1971 ( S.I. No. 307 of 1971 ), shall not apply to jewellery which is imported into the State and which originates either in a Member State of the European Communities or in a state with which the European Communities have an agreement in which there are provisions which require the abolition of measures of equivalent effect to quantitative restrictions on the importation into the State of jewellery.

(3) For the purpose of this Regulation, the country of origin of goods shall be determined in accordance with the rules of origin contained in Council Regulation EEC No. 802/681 of the 27th day of June, 1968 (as amended).

EXPLANATORY NOTE.

These Regulations are made to give effect to Article 30 of the EEC Treaty by revoking the provisions of the Merchandise Marks (Restriction on Sale of Imported Jewellery) Order, 1971 ( S.I. No. 306 of 1971 ) and the provisions of the Merchandise Marks (Restriction on Importation of Jewellery) Order, 1971 ( S.I. No. 307 of 1971 ) insofar as this Order applies to products originating in an EEC Member State or a country with which the EEC has an agreement which stipulates that measures having an effect equivalent to a quantitative restriction on trade be abolished. The provisions of the "Importation" Order will continue to apply to relevant souvenir jewellery originating in other countries.
