HARBOUR RATES (FOYNES HARBOUR) ORDER, 1984.

I, JIM MITCHELL, Minister for Communications in exercise of the powers conferred on me by section 104 of the Harbours Act, 1946 (No. 9 of 1946), and the Ministers and Secretaries (Amendment) Act, 1983 (No. 40 of 1983), and after due compliance with section 106 of the Harbours Act, 1946 , hereby order as follows:--

1. (1) This Order may be cited as the Harbour Rates (Foynes Harbour) Order, 1984.

(2) This Order shall come into operation on the 12th day of March 1984.

2. In this Order "the Order of 1983" means the Harbour Rates (Foynes Harbour) Order, 1983 ( S.I. No. 98 of 1983 ).

3. The Harbour Rates (Foynes Harbour), Order, 1955 ( S.I. No. 63 of 1955 ), is hereby amended by--

( a ) the substitution of the following paragraph for paragraph (2) of Article 2 (inserted by the Order of 1983):

"(2) Where rates fixed under this Order are payable at a metric ton charge, lesser weights shall be chargeable as follows:--

( a ) any weight not exceeding 500 kilos shall count as 500 kilos;

( b ) any weight exceeding 500 kilos and less than 1 tonne shall count as a tonne.".

( b ) the substitution for the First Schedule (inserted by the Order of 1983) thereto of the following Schedule:

19. Goods not mentioned in any other reference in this Schedule. per tonne 0.94

Rates on Exports shall be the same as Rates on Imports, except in the case of goods imported at the Port of Foynes from any Port for export to any other Port and on which Import Goods Rates have been paid. In such case the Export Rate will be half the Import Rate provided:

( a ) That the Goods are exported in the same form and, if imported in packages, in the same packages as they arrived.

( b ) That the Goods remain the bona fide sole property of the same person throughout.

( c ) That the export takes place within two months of the date of arrival of the importing Vessel."

( a ) the substitution for the Second Schedule (inserted by the Order of 1983) thereto of the following Schedule:

The Tonnage of a Vessel upon which Tonnage Rates shall be based and chargeable mentioned at Reference Numbers (1) to (5) inclusive of this Schedule shall be the Net Register Tonnage or fifty per cent of the Gross Tonnage of the Vessel concerned whichever is the greater.

The word "week" in the Reference Number (5), in this Schedule means any period of 7 consecutive days" and

( d ) the substitution for the Third Schedule (inserted by the Order of 1983) thereto of the following Schedule:

4. The Order of 1983 is hereby revoked.

EXPLANATORY NOTE.

This Order authorises the Foynes Harbour Trustees to increase goods, tonnage and other charges.
