HEALTH (HOSPITAL IN-PATIENT CHARGES) REGULATIONS, 1984.

The Minister for Health, in exercise of the powers conferred on him by section 5 of the Health Act, 1947 (No. 28 of 1947) and by section 53 (2) of the Health Act, 1970 (No. 1 of 1970), hereby makes the following Regulations:

1. These Regulations may be cited as the Health (Hospital In-Patient Charges) Regulations, 1984.

2. In these Regulations "health contributions" means contributions payable under the Health Contributions Acts, 1971 to 1978 or under the Health Contributions Act, 1979 (No. 4 of 1979) in accordance with a demand under article 17 of the Health Contributions Regulations, 1979 ( S.I. No. 107 of 1979 ).

3. (1) A charge shall be made for in-patient services provided under section 52 of the Health Act, 1970 , for persons who, on the date of their admission for such services have not discharged their liability for health contributions in respect of any completed contribution year before the 1st day of June preceding such admission, save that a charge shall not be made in respect of services provided for:--

(a) women in respect of motherhood or

(b) the diagnosis or treatment of infectious diseases prescribed under Part IV of the Health Act, 1947 .

(2) The charge referred to in sub-article (1) shall be at the rate of £100 in respect of each admission for in-patient services and shall be payable to the health board providing such services or on whose behalf such services are provided.

4. The charge referred to in article 3 shall not be payable where the amount of the health contribution payable has not been finally determined and the Chief Executive Officer of the appropriate health board is satisfied that the person has made a substantial payment on account of such health contribution.

5. These Regualtions shall come into operation on the 1st day of June, 1984.

EXPLANATORY NOTE.

These Regulations provide that, with effect from 1st June, 1984, persons admitted for hospital in-patient services in a public hospital who are in arrears with the health contributions will be liable for an admission charge of £100.
