ROAD TRAFFICE ACT, 1961 (SECTION 103) (OFFENCES) (AMENDMENT) REGULATIONS, 1985.

ROAD TRAFFICE ACT, 1961 (SECTION 103) (OFFENCES) (AMENDMENT) REGULATIONS, 1985.

The Minister for the Environment in exercise of the powers conferred on him by sections 5 and 103 of the Road Traffic Act, 1961 (No. 24 of 1986) (as amended by sections 6 and 64 of the Road Traffic Act, 1968 (No. 25 of 1968)) and section 74 of the Finance Act, 1976 (No. 16 of 1976) hereby makes the following Regulations:

1. (1) These Regulations may be cited as the Road Traffic Act, 1961 (Section 103) (Offences) (Amendment) Regulations, 1985.

(2) These Regulations and the Road Traffic Act, 1961 (Section 103) (Offences) Regulations, 1976 to 1983 shall be construed together as one and may be collectively cited as the Road Traffic Act, 1961 (Section 103) (Offences) Regulations, 1976 to 1985.

2. In these Regulations--

"The Principal Regulations" means the Road Traffic Act, 1961 (Section 103) (Offences) Regulations, 1976 ( S.I. No. 188 of 1976 );

"The 1983 Regulations" means the Road Traffic Act, 1961 (Section 103) (Offences) (Amendment) Regulations, 1983 ( S.I. No. 90 of 1983 ).

3. The following article is hereby substituted for article 5 (as substituted by article 3 of the 1983 Regulations) of the Principal Regulations--

"5. The prescribed amounts for the purposes of section 103 (2) (b) and of section 103 (3) (b) of the Act for offences declared by the Minister to be offences to which section 103 of the Act applies shall be--

( a ) fifteen pounds in respect of the offence of stopping or parking during a clearway period on a part of a roadway which is a clearway in contravention of a bye-law or rule under section 89 or section 90 of the Act (as amended by section 6 of the Road Traffic Act, 1968 ),

( b ) fifteen pounds in respect of the offence of parking on a part of a roadway which is a bus lane in contravention of a bye-law or rule under section 90 of the Act (as amended by section 6 of the Road Traffic Act, 1968 ),

( c ) fifteen pounds in respect of an offence under section 73 of the Finance Act, 1976 , and

( d ) ten pounds in respect of all other offences."

4. The First Schedule to the Principal Regulations (as amended by article 4 of the 1983 Regulations) is hereby amended by the substitution of the words "fifteen pounds or ten pounds" for the words "ten pounds, seven pounds or five pounds" in each case where they occur in the said Schedule.

5. These Regulations shall come into force on the 2nd day of September, 1985.

EXPLANATORY NOTE.

These Regulations amend the Road Traffic Act, 1961 (Section 103) (Offences) Regulations, 1976 to 1983, by increasing with effect from 2nd September, 1985, the amount which a person liable to prosecution for an offence to which section 103 of the Act applies may pay as an alternative to the institution of a prosecution, as follows:

£10 (from £5) in respect of a parking offence,

£15 (from £5) in respect of the offence of non-display of a tax disc,

£15 (from £10 in the case of the Dublin area and £7 in other cases) in respect of a clearway offence,

£15 (from £10 in the case of the Dublin area and £5 in other cases) in respect of the offence of parking in a bus lane.
