S.I. No. 184/1987:

ROAD TRAFFIC (PUBLIC SERVICE VEHICLES) (AMENDMENT) (No. 2) REGULATIONS, 1987.

ROAD TRAFFIC (PUBLIC SERVICE VEHICLES) (AMENDMENT) (No. 2) REGULATIONS, 1987.

The Minister for the Environment in exercise of the powers conferred on him by section 5 of the Road Traffic Act, 1961 (No. 24 of 1961) and section 82 of that Act, as amended by section 57 of the Road Traffic Act, 1968 (No. 25 of 1968) hereby makes the following Regulations:--

1. (1) These Regulations may be cited as the Road Traffic (Public Service Vehicles) (Amendment) (No. 2) Regulations, 1987.

(2) The Road Traffic (Public Service Vehicles) Regulations, 1963 to 1987 and these Regulations shall be construed as one and may be cited together as the Road Traffic (Public Service Vehicles) Regulations, 1963 to 1987.

2. In these Regulations:--

"Kilkenny Corporation" means the Mayor, Aldermen and Burgesses of Kilkenny.

"Sligo Corporation " means the Mayor, Alderman and Burgesses of Sligo.

3. (i) Column 1 of the table to article 5 of the Road Traffic (Public Service Vehicles) (Licensing) Regulations, 1978 ( S.I. No. 292 of 1978 ) (as amended) is hereby amended by the addition thereto of the following local authorities; Sligo Corporation, Kilkenny Corporation, Carlow Urban District Council, Naas Urban District Council and Longford Urban District Council.

(ii) Column (2) of the table to the said article is amended by the addition thereto of the following areas; the Borough of Sligo, the Borough of Kilkenny, the Urban District of Carlow, the Urban District of Naas and the Urban District of Longford.

4. Notwithstanding article 3 of these Regulations article 5 of the Road Traffic (Public Service Vehicles) (Licensing) Regulations, 1978 shall not apply in respect of the use of vehicles as public hire vehicles in the Boroughs of Sligo and Kilkenny or in the Urban Districts of Carlow, Naas and Longford during the grant period commencing on the 1st day of September, 1987.

6. Notwithstanding the provisions of article 6 (2) of the Road Traffic (Public Service Vehicles) (Licensing) Regulations, 1978 the period in the year 1987 within which applications for the grant of new public hire vehicle licences in respect of the use of vehicles as public hire vehicles in the Boroughs of Sligo and Kilkenny and in the Urban Districts of Carlow, Naas and Longford may be made shall be the period from the first to the fourteenth day inclusive of the month of August.

EXPLANATORY NOTE.

These Regulations further amend the Road Traffic (Public Service Vehicles) (Licensing) Regulations, 1978 for the designation of the boroughs of Sligo and Kilkenny and the urban Districts of Carlow, Naas and Longford as public hire areas and for the granting by the Garda Commissioner of licences for the use of vehicles as public hire vehicles in the areas in question.

The Regulations provide that in the year ending 31st August, 1987 applications for such licences may be made only between 1st and 14th August in the Boroughs of Sligo and Kilkenny and the Urban Districts of Carlow, Naas and Longford. Each of those local authorities will determine in respect of each year from 1st September, 1987 the number of new public hire vehicle licences which may be granted for the areaby the Garda Commissioner and the periods within which applications may be made for new licences.
