EUROPEAN COMMUNITIES (DETERGENTS) (AMENDMENT) REGULATIONS, 1988.

I, ALBERT REYNOLDS, Minister for Industry and Commerce, in exercise of the powers conferred on me by ( section 3 of the European Communities Act, 1972 ) (No. 27 of 1972), and for the purpose of giving effect to Council Directive No. 86/94/EEC of 10 March, 1986¹, hereby make the following regulations:

1. These Regulations may be cited as the European Communities (Detergents) (Amendment) Regulations, 1988.

2. The European Communities (Detergents) Regulations, 1984 S.I. No. 43 of 1984 ²), are hereby amended by the substitution for Regulation 4 of the following Regulation:

"4. (1) (a) Subject to subparagraph (b) of this paragraph and to paragraph (2) of this Regulation, Regulation 3 of these Regulations shall not apply to a product which is a product mentioned in subparagraph (a) or (b) of Article 2 (a) (1) (inserted by Article 1 of Council Directive No. 86/94/EEC of 10 March, 1986²) of the Directive.

(b) The exemption contained in subparagraph (a) of this paragraph is subject to compliance by the products to which it relates with the following conditions, namely--

(i) in case the product comes on the market after the 30th day of September, 1983, it shall comply with the requirements of Article 2a (2) (inserted by Article 5 of Council Directive No. 82/242/EEC of 31 March, 1982²) of the Directive, and

(ii) in case non-ionic surfactants are used in the product, it shall comply with the requirements of Article 2a (3) (as so inserted) of the Directive.

(2) This Regulation shall cease to have effect on the 31st day of December, 1989.".

EXPLANATORY NOTE.

The purpose of these Regulations is to give legal effect to Council Directive 86/94/EEC which permits the continuation, until 31 December 1989, of certain exemptions for non-ionic surfactants which do not comply with the biodegradability limits laid down in Directive 7¾04/EEC relating to Detergents, as amended by Directive 82/242/EEC.

These Regulations should be read together with the Council Directives.
