I, ALBERT REYNOLDS, Minister for Industry and Commerce, in exercise of the powers conferred on me by ( section 3 of the European Communities Act, 1972 ) (No. 27 of 1972), and for the purpose of giving effect to Council Directive No. 86/94/EEC of 10 March, 19861, hereby make the following regulations: |

1. These Regulations may be cited as the European Communities (Detergents) (Amendment) Regulations, 1988. |
||
2. The European Communities (Detergents) Regulations, 1984 S.I. No. 43 of 1984 2), are hereby amended by the substitution for Regulation 4 of the following Regulation: |

"4. (1) (a) Subject to subparagraph (b) of this paragraph and to paragraph (2) of this Regulation, Regulation 3 of these Regulations shall not apply to a product which is a product mentioned in subparagraph (a) or (b) of Article 2 (a) (1) (inserted by Article 1 of Council Directive No. 86/94/EEC of 10 March, 19862) of the Directive. |

(b) The exemption contained in subparagraph (a) of this paragraph is subject to compliance by the products to which it relates with the following conditions, namely-- |
||
(i) in case the product comes on the market after the 30th day of September, 1983, it shall comply with the requirements of Article 2a (2) (inserted by Article 5 of Council Directive No. 82/242/EEC of 31 March, 19822) of the Directive, and |

(ii) in case non-ionic surfactants are used in the product, it shall comply with the requirements of Article 2a (3) (as so inserted) of the Directive. |
||
(2) This Regulation shall cease to have effect on the 31st day of December, 1989.". |

EXPLANATORY NOTE. |
||
The purpose of these Regulations is to give legal effect to Council Directive 86/94/EEC which permits the continuation, until 31 December 1989, of certain exemptions for non-ionic surfactants which do not comply with the biodegradability limits laid down in Directive 7¾04/EEC relating to Detergents, as amended by Directive 82/242/EEC. |
||
These Regulations should be read together with the Council Directives. |
||
