URBAN RENEWAL ACT, 1986 (DESIGNATED AREAS) ORDER, 1988.

The Minister for the Environment, in exercise of the powers conferred on him by section 6 (2) of the Urban Renewal Act, 1986 (No. 19 of 1986), hereby orders as follows:

1. This Order may be cited as the Urban Renewal Act, 1986 (Designated Areas) Order, 1988.

2. Each of the areas described in part II of the Schedule to this Order is hereby declared to be a designated area for the purposes of the urban Renewal Act, 1986 .

SCHEDULE

Part I

In this Schedule--

"thoroughfare" includes any avenue, bridge, burn, channel, drive, entrance, footpath, gardens, gate, lane, laneway, mall, market, parade, pathway, place, quay, race, river, road, row, square, street, town, view, walk, wall and way;

a reference to a line drawn along any thoroughfare is a reference to a line drawn along the centre of that thoroughfare;

a reference to a projection of any throughfare is a reference to a projection of a line drawn along the centre of that throughfare;

a reference to the point where any thoroughfare or projection of any thoroughfare intersects or joins any other thoroughfare or projection of a thoroughfare is a reference to the point where a line drawn along the centre of one thoroughfare, or in the case of a projection of a thoroughfare, along the projection, would be intersected or joined by a line drawn along the centre of the other thoroughfare or, in the case of an other projection of a thoroughfare, along the other projection;

a reference to a point where any thoroughfare or projection of a thoroughfare intersects or joins a boundary is a reference to the point where a line drawn along the centre of such thoroughfare or, in the case of another projection of a thoroughfare, along the projection would intersect or join such boundary.

Part II

Description of Designated Area in Athlone

That part of the urban district of Athlone bounded by a line commencing at the point (hereafter in this description referred to as "the first-mentioned point") where Connaught Street meets Patrick Street, then continuing along Patrick Street to the point where it intersects the westerly projection of the northern boundary of No. 1 Patrick Street, then continuing, initially in an easterly direction, along that projection and that boundary and the eastern boundary of No. 1 Patrick Street to the point where it meets the laneway which provides rear access to the premises at numbers 1 to 42 Parnell Square, then continuing along that laneway to its junction with Deer Park Road, then continuing in an easterly direction along Deer Park Road and the easterly projection of Deer Park Road to the point where it intersects the northerly projection of the western boundary of the area described as "liable to flooding" on Ordnance Survey map 3035-25, then continuing, initially in a southerly direction, along that projection and that boundary for a distance of 109 metres measured along that boundary, then continuing in an easterly direction in an undefined straight line to the point where it intersects the River Shannon, then continuing, initially in a northerly direction, along the River Shannon to the point where it is intersected by the north-easterly projection of Main Street, then continuing, initially in a south-westerly direction, along that projection and Main Street to its junction with Fry Place, then continuing, initially in a westerly direction, along Fry Place, High Street, Bastion Street, O'Connell Street and Connaught Street to the first-mentioned point.

Description of Designated Area in Castlebar

That part of the urban district of Castlebar bounded by a line commencing at the point (hereafter in this description referred to as "the first-mentioned point") where Upper Thomas Street meets Kennedy Gardens, then continuing, initially in a southerly direction, along Upper Thomas Street, Richard Street and Lower Charles Street to the point where it would be intersected by the north-easterly projection of the north-westerly direction along the last-mentioned projection to the point where it meets the boundary of McCormack Estate, then continuing, initially in a westerly direction, along the north-western boundary of McCormack Estate and the south-westerly projection of the last-mentioned boundary to the point where it intersects the Castlebar River, then continuing, initially in a north-westerly direction, along the Castlebar River to the point where it is intersected by the south-easterly projection of the north-eastern boundary of the De La Salle Brothers monastery, then continuing in a north-westerly direction along that projection and that boundary and the north-westerly projection of that boundary to the point where it intersects Upper Chapel Street, then continuing in a north-easterly direction along Upper Chapel Street and Lower Chapel Street to its junction with Kennedy Gardens, then continuing in an easterly direction along Kennedy Gardens to the first-mentioned point.

Description of Designated area in Dublin

That part of the county borough of Dublin bounded by a line commencing at the point (hereafter in this description referred to as "the first-mentioned point") where William's Row (also known as Bachelors Way) joins the Lotts, then continuing in a northerly direction along William's Row to the point where it joins Abbey Street Middle, then continuing in a westerly direction along Abbey Street Middle and Abbey Street Upper to the point where it joins Jervis Street, then continuing in a southerly direction along Jervis Street to the point where it joins Strand Street Great, then continuing in an easterly direction along Strand Street Great to the point where it joins Liffey Street Lower, then continuing in a northerly direction along Liffey Street Lower to the point where it joins the Lotts, then continuing along the Lotts to the first-mentioned point.

Description of Designated Areas in Dundalk

Central Area

That part of the urban district of Dundalk bounded by a line commencing at the point (hereafter in this description referred to as "the first-mentioned point") where the Long Walk joins Demesne Road, then continuing, initially in a southerly direction, along Demesne Road and Park Drive to the point where it joins Park View, then continuing, initially in a north-easterly direction, along Park View to the point where it joins Park Avenue, then continuing along Park Avenue and Market Square to the point where it joins Clanbrassil Street, then continuing, initially in a northerly direction, along Clanbrassil Street to the point where it is intersected by the easterly projection of the northern boundary of No. 63 Clanbrassil Street, then continuing, initially in a westerly direction, along the last-mentioned projection and the northern and western boundaries of No. 63 Clanbrassil Street to the point where it meets the easterly projection of the northern portion of the Long Walk, then continuing, initially in a westerly direction, along the last-mentioned projection and the Long Walk to the first-mentioned point.

Distillery Works

That part of the urban district of Dundalk bounded by a line commencing at the point (hereafter in this description referred to as "the first-mentioned point") where Distillery Lane joins Jocelyn Street, then continuing in a southerly direction along Distillery Lane to the point (hereafter in this description referred to as "the second-mentioned point") where it meets the Rampart River, then continuing in a westerly direction along the Rampart River for a distance of approximately 122 metres from the second-mentioned point to the point where it is intersected by the southerly projection of the eastern boundary of the Presbytery, then continuing, initially in a northerly direction along the last-mentioned projection and the last-mentioned boundary and the northerly projection of the last mentioned boundary to the point where it intersects Roden Place, then continuing, initially in an easterly direction, along Roden Place and Jocelyn Street to the first-mentioned point.

Description of Designated Areas in Kilkenny

Dean Street

That part of the borough of Kilkenny bounded by a line commencing at the point (hereafter in this description referred to as "the first-mentioned point") where Dean Street meets Blackmill Bridge, then continuing along Blackmill Bridge to the point where it intersects the Breagagh River, then continuing, initially in an easterly direction, along the Breagagh River to the point where it is intersected by Water Gate, then continuing in a north-westerly direction along Water Gate and Irish Town to its junction with Dean Street, then continuing, initially in a south-westerly direction, along Dean Street to the first-mentioned point.

Parliament Street/High Street Backlands

That part of the borough of Kilkenny bounded by a line commencing at the point (hereafter in this description referred to as "the first-mentioned point") where High Street is intersected by the north-easterly projection of the south-eastern boundary of Chapel Lane, then continuing, initially in a south-westerly direction, along that projection and the last-mentioned boundary, the western boundary of Chapel Lane and the northerly projection of the last-mentioned boundary to the point where it meets the south-eastern boundary of the Mother of Fair Love School, then continuing, initially in a north-easterly direction, along the south-eastern boundary and north-eastern boundary of the Mother of Fair Love School and the north-westerly projection of the last-mentioned boundary to the point where it intersects James Street, then continuing in a north-easterly direction along James Street to the point where it is intersected by the south-easterly projection of the western boundary of Tilbury Place, then continuing, initially in a north-westerly direction, along the last-mentioned projection and the last-mentioned boundary to the point where it meets the domestic garage at the north-western corner of Evan's Lane, then continuing, initially in a north-easterly direction, along the boundary of that garage to the point where it meets the City Wall, then continuing, initially in northerly direction, along the City Wall and the northerly projection of the City Wall to the point where it meets the northern boundary of New Buildings Lane, then continuing in a north-easterly direction along the last-mentioned boundary and the north-easterly projection of the-last mentioned boundary to the point where it intersects Parliament Street, then continuing in a south-easterly direction along Parliament Street and High Street to the first-mentioned point.

Description of Designated area in Letterkenny

That part of the urban district of Letterkenny bounded by a line commencing at the point (hereafter in this description referred to as "the first-mentioned point") where Church Lane joins Upper Main Street, then continuing in a southerly direction along Upper Main Street to the point where it joins Rosemount Lane, then continuing in a south-easterly direction along Rosemount Lane for a distance of approximately 130 metres from the last-mentioned point to its intersection with the north-easterly projection of the south-eastern wall of Rose Cottage, then continuing, initially in a south-westerly direction, along the last-mentioned projection, the last-mentioned wall and the south-western wall of Rose Cottage to the south-western corner of Rose Cottage, then continuing along the south-westerly projection of the north-western wall of Rose Cottage, for a distance of approximately 47 metres from the last-mentioned corner to the point where it intersects the south-easterly projection of the pedestrian right-of-way to Lower Main Street, then continuing in a south-easterly direction along the last-mentioned projection for a distance of approximately 31 metres from the last-mentioned point to the point where the last-mentioned projection first intersects a field boundary, then continuing in a south-westerly direction along that field boundary and the south-westerly projection of that field boundary to the point where the last-mentioned projection intersects the north-eastern boundary of the St. Oliver Plunkett Road car park, then continuing, initially in a north-westerly direction, along the north-eastern boundary and north-western boundary of that car park and the south-westerly projection of the last-mentioned boundary to the point where the last-mentioned projection intersects St. Oliver Plunkett Road, then continuing in a south-easterly direction along St. Oliver Plunkett Road to the point where it joins Pearse Road, then continuing in a south-westerly direction along Pearse Road for a distance of approximately 95 metres from the last-mentioned point to the point where Pearse Road is intersected by the south-easterly projection of the south-western boundary of the field owned by Nellie McGovern (which field forms the northerly part of Valuation Office lot 73 in the townland of Letterkenny), then continuing, initially in a north-westerly direction, along the last-mentioned projection and the south-western boundary and north-western boundary of the last-mentioned field to the point where it meets the southern corner of No. 40 Lower Main Street, then continuing in a straight undefined line to the south-western corner of No. 36 Lower Main Street, then continuing in a straight undefined line to the southern corner of No. 39 Lower Main Street, then continuing, initially in a north-westerly direction, along the southern and western boundaries of numbers 39 and 37 Lower Main Street and the south-western boundary of No. 35 Lower Main Street to the western corner of No. 35 Lower Main Street, then continuing in a south-westerly direction along the south-westerly projection of the north-western boundary of No. 35 Lower Main Street to the point where it intersects the Back Burn, then continuing, initially in a north-westerly direction, along the Back Burn to the point where it intersects the north-easterly projection of the south-eastern facades of the private dwellings backing onto the Convent (which dwellings form part of the private housing estate on the eastern side of Convent Road), then continuing in a north-easterly direction along the last-mentioned projection for a distance of approximately 97 metres from the last-mentioned point to its intersection with the southerly projection of the eastern boundary of the Convent, then continuing, initially in a northerly direction, along the last-mentioned projection and that eastern boundary to the point where it meets Mount Southwell Place, then continuing, initially in an easterly direction, along Mount Southwell Place and Castle Street to the point where it joins Church Lane, then continuing in an easterly direction along Church lane to the first-mentioned point.

Description of Designated Areas in Limerick

Milk Market

That part of the county borough of Limerick bounded by a line commencing at the point (hereafter in this description referred to as "the first-mentioned point") where Michael Street joins Punch's Row, then continuing in an easterly direction along Punch's Row to the point where it joins Carr Street, then continuing, initially in a southerly direction, along Carr Street to the point where it meets Corn Market Row, then continuing in a south-easterly direction along Corn Market Row to the point where it meets Mungret Street, then continuing in a north-easterly direction along Mungret Street to the point where it joins the pedestrian way lying beside the north-eastern boundary of number 72 Mungret Street, then continuing in a north-westerly direction along that pedestrian way and its north-westerly projection to the point where it joins the south-eastern boundary of Tara Court, then continuing in a north-easterly direction along that boundary to the point where it joins the footpath lying along the northern boundaries of Tara Court and St. Michael's Court, then continuing along that footpath to the point where it joins Michael Street, then continuing in a south-westerly direction along Michael Street to the first-mentioned point.

Clare Street

That part of the county borough of Limerick bounded by a line commencing at the point (hereafter in this description referred to as "the first mentioned point") where Clare Street meets St. Lelia Street, then continuing in a southerly direction along St. Lelia Street to the point where it meets Moores Lane, then continuing along Moores Lane to the point where it meets O'Sullivan's Place, then continuing in a southerly direction along O'Sullivan's Place to the point where it meets Old Clare Street, then continuing in a westerly direction along Old Clare Street to the point (at the western end of Old Clare Street) where it meets Curry Lane, then continuing in a northerly direction along Curry Lane to the point where it meets Lock Quay, then continuing in an easterly direction along Lock Quay to the point where it meets Clare Street, then continuing in a south-easterly direction along Clare Street to the first-mentioned point.

Description of Designated Areas in Sligo

The Mall/Bridge Street Area

That part of the borough of Sligo bounded by a line commencing at the point (hereafter in this description referred to as "the first-mentioned point") where Bridge Street meets The Mall, then continuing along Bridge Street and the New Bridge to the point where it intersects the Garvoge River, then continuing in an easterly direction along the Garvoge River to the point where it intersects the southern projection of River Lane (which lane lies immediately east of Higgins Shop on The Mall and connects the Mall to the Garvoge River), then continuing in a northerly direction along that projection and that lane and the northerly projection of that lane to the point where it meets the Mall, then continuing in a westerly direction along the Mall to the first-mentioned point.

O'Connell Street/Rockwood Parade

That part of the borough of Sligo bounded by a line commencing at the point (hereafter in this description referred to as "the first-mentioned point") where O'Connell Street meets Grattan Street, then continuing in an easterly direction along Grattan Street and Castle Street to its junction with Thomas Street, then continuing in a northerly direction along Thomas Street and the New Bridge to the point where it intersects the Garvoge River, then continuing, initially in a westerly direction, along the Garvoge River, to the point where it is intersected by the northerly projection of Quay Street, then continuing in a southerly direction along the last-mentioned projection and Quay Street to its junction with Lower Knox Street, then continuing in an easterly direction along Lower Knox Street to its junction with O'Connell Street, then continuing in a southerly direction along O'Connell Street to the first-mentioned point.

Market Place

That part of the borough of Sligo bounded by a line commencing at the point (hereafter in this description referred to as "the first-mentioned point") where Domonic Street meets West Gardens, then continuing in an easterly direction along West Gardens to its junction with High Street, then continuing in a southerly direction along High Street and Connolly Street to its junction with Temple Street, then continuing along Temple Street to its junction with Market Yard Entrance South, then continuing in a northerly direction along Market Yard Entrance South to the point where it intersects the easterly projection of the southern wall of Market Place, then continuing in a westerly direction along the last-mentioned projection and the last-mentioned wall and the southern wall of the warehouse which adjoins the southern side of the old fire station, then continuing along the western wall of the last-mentioned warehouse, the western wall of the old fire station, the southern wall of the warehouse which adjoins the north-western corner of the old fire station, the western wall of the last-mentioned warehouse and the north-easterly projection of the last-mentioned wall to the point where it meets Domonic Street, then continuing in a northerly direction along Domonic Street to the first-mentioned point.

Description of Designated Areas in Tralee

Market Place

That part of the urban district of Tralee bounded by a line commencing at the point (hereafter in this description referred to as "the first-mentioned point") where Russell Street joins with Bridge Street, then continuing in an easterly direction along Bridge Street to its junction with Milk Market Lane, then continuing, initially in a north-easterly direction, along Milk Market Lane and Church Street to the point where it joins Ashe Street, then continuing in a north-easterly direction along Ashe Street to the point where it is intersected by the easterly projection of the southern boundary of the Rectory, then continuing initially in a westerly direction, along the last-mentioned projection and last-mentioned boundary and the southern boundary of the school to the point where it meets the boundary of the Creamery, then continuing, initially in a northerly direction, along the boundary of the Creamery to the point where it is intersected by the eastern portion of St. John's Park (such eastern portion of St. John's Park being the roadway which provides front access to numbers 13 to 26 St. John's Park), then continuing in a northerly direction along the eastern portion of St. John's Park to the point where it meets the laneway (lying between numbers 20 and 70 St. John's Park to the south and numbers 21 and 69 St. John's Park to the north) connecting the eastern and western portions of St. John's Park, then continuing in a westerly direction along the last-mentioned laneway to the point where it joins the western portion of St. John's Park, then continuing, initially in a southerly direction, along St. John's Park, to the point where it joins Rock Street, then continuing, initially in a southerly direction, along Rock Street to its junction with Russell Street, then continuing along Russell Street to the first-mentioned point.

That part of the urban district of Tralee which is bounded by a line commencing at the point (hereafter in this description referred to as "the first-mentioned point") where Basin Road meets James Street, then continuing in a northerly direction along Basin Road and Chapel Street to its junction with Cross lane, then continuing along Cross Lane to the point where it meets the western boundary of No. 10 Day Place, then continuing, initially in a southerly direction, along the western and southern boundaries of No. 10 Day Place and the easterly projection of the southern boundary of No. 10. Day Place to the point where it intersects Godfrey Place, then continuing in a southerly direction along Godfrey Place and Princes Quay to its junction with James Street, then continuing along James Street to the first-mentioned point.

Description of Designated Areas in Tullamore

Central Area

That part of the urban district of Tullamore bounded by a line commencing at the point (hereafter in this description referred to as 'the first-mentioned point') where Meath Lane intersects High Street, then continuing in a northerly direction along the High Street, Bridge Street and Columcille Street to the point where it intersects the westerly projection of Galvins Walk, then continuing in an undefined straight line in a westerly direction to the south-west corner of the main supermarket building (Quinnsworth), then continuing along the western wall of the last-mentioned building to the north-western corner of the last-mentioned building, then continuing in an undefined straight line to the point where O'Connell Street is intersected by the south-easterly projection of the pathway (immediately south of the playground) which connects St. Kyrans Street and Cox's Bridge, then continuing in a north-westerly direction along the last-mentioned projection and the last-mentioned pathway to the point where it is intersected by the north-easterly projection of the south-eastern boundary of the licensed premises known as "The Lantern", then continuing in a south-westerly direction along the last-mentioned projection and the last-mentioned boundary and the south-westerly projection of the last-mentioned boundary to the point where it meets Kilbride Street, then continuing, initially in a south-easterly direction, along Kilbride Street, Water Lane and Marian Place to the point where it intersects the northerly projection of the eastern boundary of No. 78 Marian Place, then continuing in a southerly direction along the last-mentioned projection, the last mentioned boundary and the southern boundary of 78 Marian Place to the south-western corner of No. 78 Marian Place, then continuing in an undefined straight line in a south-easterly direction to the point where the northernmost section of the disused Mill Race intersects the Tullamore River, then continuing in a south-westerly direction along the Tullamore River to the point where it intersects the north-westerly projection of the most westerly channel of the disused Mill Race, then continuing, initially in a south-easterly direction, along the last-mentioned projection, the last-mentioned channel and the disused Mill Race to the south-western face of the former mill bridge, then continuing in a south-easterly direction along the last mentioned face and the south-easterly projection of the last-mentioned face to the point where it intersects the south-westerly projection of Meath lane, then continuing, initially in a north-easterly direction, along the last-mentioned projection and Meath lane to the first-mentioned point.

Tanyard

That part of the urban district of Tullamore bounded by a line commencing at the point (hereafter in this description referred to as "the first-mentioned point") on Tanyard Lane which is 238 metres from the centre of the Roundabout at the intersection of Bachelor's Walk and Tanyard Lane measured along Tanyard Lane, then continuing in a westerly direction along Tanyard Lane to the point (hereafter in this description referred to as the "second mentioned point") which is 218 metres from the first-mentioned point, then continuing in a southerly direction along the adjacent property boundary to the point (hereafter in this description referred to as "the third-mentioned point"), which is 84 metres from the second-mentioned point, then continuing in an easterly direction in an undefined straight line to the point which is 204 metres from the third-mentioned point and 72 metres from the first-mentioned point, then continuing in a northerly direction along the adjoining property boundary to the first-mentioned point.

Description of Designated Areas in Wexford

Redmond Place/Selskar Area

That part of the borough of Wexford bounded by a line commencing at the point (hereafter in this description referred to as "the first-mentioned point") where West Gate is intersected by the southerly projection of the western boundary of Kaats Lane (which lane runs in a northerly direction from West Gate and is bounded at its southern end by the "Wexford Car Centre" to the west and ""West Gate Kitchens" to the east) then continuing in a northerly direction along that projection and that boundary and the north-easterly projection of that boundary to the point where it intersects the eastern boundary of Auburn Terrace, then continuing, initially in a north-easterly direction, along the last-mentioned boundary and the north-easterly projection thereof to the south-western boundary of the railway line, then continuing in a south-easterly direction along the said boundary of the railway line to the point where it intersects the south-easterly projection of Skeffington Street, then continuing in a north-westerly direction along the said projection and Skeffington Street to the point where it meets Trimmer's Lane East, then continuing along Trimmer's Lane East to its junction with Selskar Street, then continuing in a north-westerly direction along Selskar Street to the point where it meets Selskar Avenue (also known as Trimmers Lane West), then continuing in a south-westerly direction along Selskar Avenue and the westerly projection of Selskar Avenue to the point where it meets the boundary of St. Selskar's Church, then continuing, initially in a southerly direction, along the last-mentioned boundary to the point where it intersects the line of the city wall, then continuing, initially in a north-westerly direction, along the line of the city wall to the boundary of the ancient tower, then continuing, initially in a north-westerly direction, along that boundary to the point where it meets the line of the city wall, then continuing in a northerly direction along the city wall and its northerly projection to West Gate, then continuing in a north-westerly direction along West Gate to the first-mentioned point.

Cornmarket Area

That part of the borough of Wexford bounded by a line commencing at the point (hereafter in this description referred to as "the first-mentioned point") where Mallon Street (also known as Back Street) meets Rowe Street Lower, then continuing in a north-easterly direction along Rowe Street Lower to the point where it intersects North Main Street, then continuing, initially in a northerly direction, along North Main Street, Cornmarket and Mallon Street to the first-mentioned point.

EXPLANATORY NOTE.

This order provides for the designation of areas under the Urban Renewal Act, 1986 . The order contains a formal description of the designated areas. These areas are located in Athlone, Castlebar, Dublin, Dundalk, Kilkenny, Letterkenny, Limerick, Tralee, Tullamore, Sligo and Wexford.
