MERCHANT SHIPPING (FEES) REGULATIONS, 1989.

I, BRENDAN DALY, Minister for the Marine, in exercise of the powers conferred on me by section 26 of the Merchant Shipping (Load Lines) Act, 1968 (No. 17 of 1968), section 3 of the Merchant Shipping (Certification of Seamen) Act, 1979 (No. 37 of 1979), and the Communications (Transfer of Departmental Administration and Ministerial Functions) Order, 1987 ( S.I. No. 91 of 1987 , and with the approval of the Minister for Finance hereby make the following Regulations:

1. These Regulations may be cited as the Merchant Shipping (Fees) Regulations, 1989, and shall come into operation on the 1st day of June, 1989.

2. The First Schedule to the Merchant Shipping (Fees) Order, 1987 ( S.I. No. 347 of 1987 ), is hereby amended by--

(a) the insertion, in Part 4, after paragraph 4.5 of the following paragraph:

"4.5A For the initial and subsequent inspection of the safety equipment of a fishing vessel which does not exceed 85 feet registered length in cases where the inspection is carried out concurrently with a Survey for Tonnage Measurement in accordance with Part 7:

.1 Fishing vessels of less than 40 feet in length ... ... ... ... no fee
.2 Fishing vessels of 40 feet in length and over but less than 55 feet in length ... ... ... ... £111.50
.3 Fishing vessels of 55 feet in length and over but less than 85 feet in length ... ... ... ... £223.00",

(b) the substitution, in Part 8, in paragraph 8.2.1 of "£300.00" for "£400.00",

(c) the substitution, in Part 8, for paragraph 8.6 of the following paragraph:

"Marine Engineer Officer Certificates of Competency and Marine Engine Operators Certificates of Qualification.

8.6 The fees payable on each occasion on which a candidate attends for examination for Marine Engineer Officer Certificates of Competency and Marine Engine Operator Certificates of Qualification shall, subject to subparagraphs .7 and .8, be as follows:

.1 Marine Engineer Officer Class 1 £300.00
.2 Marine Engineer Officer Class 2 £240.00
.3 Marine Engineer Officer Class 3 £120.00
.4 Marine Engineer Officer Class 4 £ 60.00
.5 Marine Engine Operator ... £ 40.00
.6 Senior Marine Engine Operator £ 40.00
.7 Where a candidate in cases .1 to .3 is examined only in Part "A" or Part "B" of the appropriate examination or for a portion of either Part "A" or Part "B" 50 per cent. of the relevant fee shall be payable.
.8 Where a candidate is examined in both steam and motor knowledge in the same week the fees payable shall be as follows:
.1 Marine Engineer Officer Class 1 ... ... ... £270.00
.2 Marine Engineer Officer Class 2 ... ... ... £220.00",

(d) the substitution, in Part 8, for paragraph 8.10 of the following paragraph:

"Certificates of Competency for Fishing Vessel Deck Officers

8.10 The fees payable on each occasion on which a candidate attends for examination for Fishing Vessel Deck Officer Certificates of Competency shall, subject to sub-paragraphs .6 and .7, be as follows:

.1 Skipper (Full) ... ... ... £170.00
.2 Skipper (Limited) ... ... £ 20.00
.3 Second Hand (Full) ... ... £120.00
.4 Second Hand (Special) ... ... £20.00
.5 Second Hand (Limited) ... £60.00
.6 Where a candidate in cases .1, .3 and .5 is examined in any part of the written but not in the practical oral part of the examination, or vice versa, 50 per cent. of the relevant fee shall be payable.
.7 Where a candidate in cases .1, .3 and .5 takes the examination in signalling separately from the remainder of the examination an additional fee of £29.00 shall be payable.", and £60.00

(e) the insertion, in Part 8, after paragraph 8.10 of the following paragraphs:

"Certificates of Competency: Engineer Officer (Fishing Vessel)

8.10A The fees payable on each occasion on which a candidate attends for examination for Engineer Officer (Fishing Vessel) Certificates of Competency shall, subject to sub-paragraphs .4, .5, .6, .7 and .8 be as follows:

.1 Engineer Officer (Fishing Vessel) Class 1 ... ... ... £200.00
.2 Engineer Officer (Fishing Vessel) Class 2 ... ... ... £120.00
.3 Engineer Officer (Fishing Vessel) Class 3 ... ... ... £ 60.00

.4 Where a candidate in case .1 is examined only in Part "A" of the examination, the fee payable shall be £80.

.5 Where a candidate in case .1 is examined only in Part "B" of the examination, the fee payable shall be £120.

.6 Where a candidate in case .4 is examined only in one subject, 50 per cent. of the fee shall be payable.

.7 Where a candidate in case .2 is examined only in Part "A" or Part "B" of the examination, 50 per cent. of the fee shall be payable.

.8 Where a candidate is examined only in one subject of Part "A" 50 per cent. of the fee shall be payable.

Fees for Certificates of Service (Fishing Vessels)

8.10B The fee payable on each occasion on which a candidate is examined for a Certificate of Service in accordance with Regulation 8 (2) and (3) of the Fishing Vessels (Certification of Deck Officers and Engineer Officers) Regulations, 1988 ( S.I. No. 298 of 1988 ), shall be £10."

EXPLANATORY NOTE.

These Regulations amend the Merchant Shipping (Fees) Order, 1987 ( S.I. No. 347 of 1987 ). The main amendments are to reduce the fees for examinations for Deck Officer Class I and Engineer Officer Class I certificates of competency by 25 per cent, to prescribe fees for examinations for fishing vessel certificates of service and fishing vessel Engineer Officer certificates of competency, to reduce the fees in respect of examinations for certain fishing vessel Deck Officer certificates of competency and to provide for a more progressive scale of fees in respect of fishing vessel safety equipment surveys.
