THE EUROPEAN COMMUNITIES (SHARING OF PASSENGER CAPACITY AND ACCESS TO SCHEDULED AIR SERVICE ROUTES) REGULATIONS, 1991.

I, SEAMUS BRENNAN, Minister for Tourism, Transport and Communications, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving full effect to Council Regulation (EEC) No. 2343/90 of 24 July 1990⁽¹⁾, hereby make the following Regulations:

1. These Regulations may be cited as the European Communities (Sharing of Passenger Capacity and Access to Scheduled Air Service Routes) Regulations, 1991.

2. In these Regulations "the Regulations of 1989" means the European Communities (Sharing of Passenger Capacity and Access to Scheduled Air Service Routes) Regulations, 1989 ( S.I. No. 208 of 1989 ).

3. Article 3 (inserted by the Air Services Authorisation (Amendment) Order, 1976 ( S.I. No. 201 of 1976 )) of the Air Services Authorisation Order, 1966 ( S.I. No. 95 of 1966 ), is hereby amended by the substitution for paragraph (j) (inserted by the Regulations of 1989) of the following paragraph:

"(j) air services operated in accordance with the provisions of Council Regulation (EEC) No. 2343/90 of 24 July 1990.".

4. The Regulations of 1989 are hereby revoked.

EXPLANATORY NOTE.

The purpose of these Regulations is to implement Council Regulation (EEC) No. 2343/90 which lays down rules for access by air carriers of Member States to scheduled intra-Community air service routes and for the sharing of passenger capacity between air carriers of Member States on scheduled air services between Member States.
