EUROPEAN COMMUNITIES (COSMETIC PRODUCTS) (AMENDMENT) REGULATIONS, 1991. |

The Minister of Health in exercise of the powers conferred on her by section 3 of the European Communities Act, 1972 (No. 27 of 1972), hereby makes the following Regulations:-- |
||
|
1. These Regulations may be cited as the European Communities (Cosmetic Products) (Amendment) Regulations, 1991. |
||
|
2. These Regulations shall be construed as one with the European Communities (Cosmetic Products) Regulations, 1990 ( S.I. No. 265 of 1990 ) and may be cited with those Regulations as the European Communities (Cosmetic Products) Regulations, 1990 and 1991. |
||
|
4. These Regulations shall come into operation on 1st day of January 1992. |
||
|
5. Article 4 (1) of the European Communities (Cosmetic Products) Regulations, 1990 is hereby amended by the addition thereto in the definition of "the Principal Directive" of the reference "91/184/EEC25". |

6. The provisions of Article 7 (1) of the European Communities (Cosmetic Products) Regulations, 1990 shall not apply until the 1st day of January 1993 as respects the requirements of Commission Directive 91/184/EEC insofar as that Directive relates to the substances referred to in paragraphs (2) to (9) of Articles 1 thereof. |

7. The provisions of Article 7 (5) of the European Communities (Cosmetic Products) Regulations, 1990 shall not apply-- |
||
|
(i) until the 31st day of December 1992, as respects the requirements of Commission Directive 91/184/EEC insofar as that Directive relates to the substances referred to in paragraph (1) of Article I thereof, and |
||
|
(ii) until the 31st day of December 1994, as respects the requirements of Commission Directive 91/184/EEC insofar as that Directive relates to the substances referred to in paragraphs (2) to (9) of Article 1 thereof. |
||

EXPLANATORY NOTE. |
||
|
The purpose of these Regulations is to update the principal regulations by giving effect to the Thirteenth Commission Directive on cosmetic products (91/184/EEC). |
||
|
The effect of the Regulations is to further safeguard public health in regard to the substances which may be contained in cosmetic products. |
||
|
The use of certain additional substances is permitted while the use of certain other substances is prohibited or permitted subject to certain restrictions and conditions. |
||
