SOCIAL WELFARE (INSURABLE (OCCUPATIONAL INJURIES) EMPLOYMENT) (AMENDMENT) REGULATIONS, 1992. |

The Minister for Social Welfare, in exercise of the powers conferred on him by sections 3 and 38 of the Social Welfare (Consolidation) Act, 1981 (No. 1 of 1981), hereby makes the following Regulations:-- |

Short title. | ||
1. These Regulations may be cited as the Social Welfare (Insurable (Occupational Injuries) Employment) (Amendment) Regulations, 1992. |
||
Commencement. | ||
2. These Regulations shall come into operation on the 6th day of April, 1992. |
||
Subsidiary employments. | ||
3. The Schedule to the Social Welfare (Subsidiary Employments) Regulations, 1991 ( S.I. No. 73 of 1991 ) is hereby amended by the insertion after paragraph 3 of the following paragraph: |
||
"4. Employment as a member of the Defence Forces involving service in either An Forsa Cosanta Áitiúil or An Slua Muirí for any period not in excess of 21 consecutive days.". |

Insurable occupational injuries employment. | ||
4. The Social Welfare (Insurable (Occupational Injuries) Employment) Regulations, 1967 ( S.I. No. 80 of 1967 ) are hereby amended by the substitution for article 5 of the following article: |
||
"5. For the purposes of section 38 of the Social Welfare (Consolidation) Act, 1981 , any employment specified in Regulations made under paragraph 4 of Part II of the First Schedule to that Act as being of such a nature that it is ordinarily adopted as subsidiary employment only and not as the principal means of livelihood, other than employment as a member of the Defence Forces involving service in either An Forsa Cosanta Áitiúil or An Slua Muirí for any period not in excess of 21 consecutive days, shall be taken as not being so specified.". |

EXPLANATORY NOTE. |
||
These Regulations provide that employment as a member of the FCA or An Slua Muirí is not insurable for social insurance purposes. |
