The Minister for Social Welfare, in exercise of the powers conferred on him by section 3 and section 140 A (1) (inserted by section 14 of the Social Welfare Act, 1993 (No. 5 of 1993)) of the Social Welfare (Consolidation) Act, 1981 (No. 1 of 1981) hereby makes the following Regulations:-- |

| Short title. | ||
|
1. These Regulations may be cited as the Social Welfare (Unemployment Assistance) (Amendment) Regulations, 1993. |
||
|
2. The Social Welfare (Unemployment Assistance) Regulations, 1992 ( S.I. No. 238 of 1992 ) are hereby amended by the insertion after article 9 of the following article-- |

"Exemption from disqualification. |
||
|
9A. A person shall not be disqualified for receiving unemployment assistance while attending a course of study within the meaning of section 140 A (2) (inserted by section 14 of the Social Welfare Act, 1993 ) of the Principal Act where that person is-- |
||
|
( a ) a mature student within the meaning of section 1 of the Local Authorities (Higher Education Grants) Act, 1968 (No. 24 of 1968) (as amended by section 2 of the Local Authorities (Higher Education Grants) Act, 1992 (No. 19 of 1992)), or |
||
|
( b ) participating in an activity as defined in article 2 of these Regulations.". |

EXPLANATORY NOTE. |
||
|
Section 140A of the Social Welfare (Consolidation) Act, 1981 disqualifies a person engaged in a course of study from receiving unemployment assistance other than in such circumstances and conditions as may be prescribed. |
||
|
These Regulations exempt from this disqualification a person who is-- |
||
|
( a ) a mature student as defined in Section 1 of the Local Authorities (Higher Education Grants) Act 1968 , or |
||
|
( b ) participating in one of the educational initiatives for the long-term unemployed such as the Vocational Training Opportunities Scheme and the Third Level Allowance scheme, or |
||
|
( c ) participating in a course of education approved by a company (known as an Area Partnership) established under the Programme for Economic and Social Progress. |
||
