I, BRIAN COWEN, Minister for Transport, Energy and Communications, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving full effect to Council Regulation (EEC) No. 2409/92 of 23 July, 19921, hereby make the following Regulations: |

1. These Regulations may be cited as the European Communities (Fares and Rates for Air Services) Regulations, 1993. |
||
2. In these Regulations-- |
||
"the Council Regulation" means Council Regulation (EEC) No. 2409/92 of 23 July, 1992; and |
||
"the Minister" means the Minister for Transport, Energy and Communications. |
||
3. A word or expression that is used in these Regulations and is also used in the Council Regulation has, unless the contrary intention appears, the same meaning in these Regulations as it has in the Council Regulation. |
||
4. Community air carriers shall notify their air fares to the Minister in a form specified by the Minister within a period (which includes a working day) of 24 hours prior to those air fares coming into effect. |
||
5. An air carrier which fails or refuses to comply with a decision of the State pursuant to Article 6 of the Council Regulation or a decision of the Commission or the Council pursuant to Article 7 of the Council Regulation shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding £1,000. |

6. The European Communities (Scheduled Air Fares) Regulations, 1991 ( S.I. No. 54 of 1991 ), are hereby revoked. |

EXPLANATORY NOTE. |
||
The purpose of these Regulations is to oblige air carriers to file with the Department of Transport, Energy and Communications, air fares on scheduled services to/from Ireland and to provide for a maximum fine of £1,000 upon summary conviction for failing to comply with an instruction to withdraw any air fares as provided for in Council Regulation (EEC) No. 2409/92 on fares and rates for air services. |
