ROAD TRAFFIC (CONSTRUCTION, EQUIPMENT AND USE OF VEHICLES) (AMENDMENT) (NO. 2) REGULATIONS, 1993.

ROAD TRAFFIC (CONSTRUCTION, EQUIPMENT AND USE OF VEHICLES) (AMENDMENT) (NO. 2) REGULATIONS, 1993.

The Minister for the Environment in exercise of the powers conferred on him by sections 5 and 11 of the Road Traffic Act, 1961 (No. 24 of 1961) hereby makes the following Regulations:

1. (1) These Regulations may be cited as the Road Traffic (Construction, Equipment and Use of Vehicles) (Amendment) (No. 2) Regulations, 1993.

(2) The Road Traffic (Construction, Equipment and Use of Vehicles) Regulations, 1963 to 1993 and these Regulations shall be construed as one and may be cited together as the Road Traffic (Construction, Equipment and Use of Vehicles) Regulations, 1963 to 1993.

(3) These Regulations shall come into operation on the 1st day of December, 1993.

2. In these Regulations:

"the Regulations of 1978" means the Road Traffic (Construction, Equipment and Use of Vehicles) (Amendment) (No. 2) Regulations, 1978 ( S.I. No. 360 of 1978 ).

3. The following article is hereby substituted for article 9 of the Regulations of 1978:

"9. In this Part of these Regulations:

"motor cycle" means a mechanically propelled bicycle, with or without a sidecar;

"crash helmet" means a helmet (or headgear) primarily intended to protect the head of a driver or passenger of a motor cycle against impact and which bears one of the approved standard marks for protective helmets set out in Column 2 of the Schedule to these Regulations.".

4. The following Schedule is hereby substituted for the Schedule to the Regulations of 1978:

Any Member State of the European community.

The approval mark of the competent standards authority of the Member State which has issued the approval.

Any country which has subscribed to the Agreement of the United Nations Economic Commission for Europe concerning the adoption and reciprocal recognition of approval for motor vehicle equipment and parts done at Geneva on 20 March 1958. si322y93p0003.gif

EXPLANATORY NOTE.

These Regulations amend the Regulations on the compulsory wearing of safety helmets meeting prescribed standards by motor cyclists and pillion passengers.

The Regulations delete references to obsolete standards: and recognise national standards of any Member State of the European Community (EC), in addition to standards laid down by the United Nations/Economic Commission for Europe (UN/ECE) Regulation No. 22.
