I, RUAIRÍ QUINN T.D., Minister for Enterprise and Employment, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Council Directive 93/95/EEC of 29 October, 1993(1) amending Council Directive 89/686/EEC of 21 December, 1989(2), on the approximation of the laws of the Member States relating to personal protective equipment (PPE), hereby make the following Regulations: |

Citation and Commencement. | ||
1. These Regulations may be cited as the European Communities (Personal Protective Equipment) (Amendment) Regulations, 1994. |

Interpretation. | ||
2. In these Regulations the "Principal Regulations" means the European Communities (Personal Protective Equipment) Regulations, 1993 ( S.I. No. 272 of 1993 ). |
||
3. The following paragraph shall be added to Regulation 3 of the Principal Regulations. |
||
"(6) Until the 1st day of July, 1995, nothing in these Regulations or in the Directive shall prohibit the placing on the market and putting into service of PPE which is in conformity with the law of the State which was in force on 30 June, 1992." |

4. Subparagraph (h) of paragraph (4) of Regulation 3 of the Principal Regulations is hereby deleted. |
||
5. The following sentence shall be added to Annex 1 to the Principal Regulations: |
||
"(5) Helmets and visors intended for users of two or three-wheeled motor vehicles." |

EXPLANATORY NOTE. |
||
These Regulations, which came into effect on 28 January, 1994 implement Council Directive 93/95/EEC which amends Council Directive 89/686/EEC on the approximation of the laws of the Member States relating to personal protective equipment (PPE). |
||
They provide that PPE may continue to be placed on the market and brought into service until 1 July, 1995 provided it is in conformity with the law of the State which was in force on 30 June, 1992. In addition, helmets and visors intended for users of two or three-wheeled motor vehicles are being excluded from the scope of the Regulations. |
