I, BRIAN COWEN, Minister for Transport, Energy and Communications, in exercise of the powers conferred on me by section 6 of the Road Transport Act, 1933 (No. 8 of 1933), and the Communications (Transfer of Departmental Administration and Ministerial Functions) (No. 2) Order, 1987 ( S.I. No. 92 of 1987 ) (as adapted by the Tourism, Transport and Communications (Alteration of Name of Department and Title of Minister) Order, 1993 ( S.I. No. 17 of 1993 )), hereby make the following Regulations:

1. (1) These Regulations may be cited as the Road Transport Acts (Vehicle Plate Application Form) Regulations, 1994.

(2) The collective citation "the Road Transport Acts Regulations, 1933 to 1994" shall include these Regulations.

(3) These Regulations shall come into operation on the 1st day of June, 1994.

2. The Road Transport Act, 1933 , (Part II) Regulations Order, 1933 ( S. R. & O. No. 120 of 1933 ), is hereby amended:

( a ) by the substitution for Regulation 7 of the following:

"7. Every application for a vehicle plate or replacement thereof shall be in the form in the Second Schedule hereto", and

( b ) by the substitution for the Second Schedule of the following Schedule:

"SECOND SCHEDULE.

ROAD TRANSPORT ACT 1933 .

Application for a Vehicle Plate or a Replacement

The Chief Superintendent

Garda Síochána

I/We hereby apply for a vehicle plate, as prescribed by section 30 of the Road Transport Act, 1933 , in respect of the following vehicle:

Unladen Weight: ____________________________________________
If the application is for a replacement of a vehicle plate which was lost, destroyed or defaced by wear or injury, state--

( a ) number of the plate to be replaced, and

( b ) the circumstances in which this occurred:

* In the case of a company, the application should be signed by a director, secretary or other responsible officer of the company.
Note: It is provided by section 30 (4) of the Road Transport Act 1933 . that a Chief Superintendent of the Garda Síochána shall not issue a vehicle plate in respect of a vehicle unless he is satisfied that such vehicle is duly licensed under section 13 of the Finance Act, 1920, as amended by subsequent enactments.".

EXPLANATORY NOTE.

The effect of the Instrument is to alter the prescribed application form for vehicle plates.
