I, BERTIE AHERN, Minister for Finance, in exercise of the powers conferred on me by subsection (3) of section 6A (inserted by section 5 of the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1960 (No. 12 of 1960) and amended by section 7 of the Oireachtas (Allowances to Members) (Amendment) Act, 1994 (No. 21 of 1994)) of the Oireachtas (Allowances to Members) Act, 1938 (No. 34 of 1938), hereby make the following regulations:

1. These Regulations may be cited as the Houses of the Oireachtas (Members) Pensions Scheme (Additional Allowances) (Deduction of Contributions) Regulations, 1994.

2. In these Regulations--

"additional allowance" in relation to a member of the Oireachtas means the allowance payable to him or her pursuant to section 2 or, as may be appropriate, 3 of the Oireachtas (Allowances to Members) (Amendment) Act, 1994 (No. 21 of 1994);

"the Fund" means the fund referred to in Clause 2 of the Scheme;

"the Scheme" means the Houses of the Oireachtas (Members) Pensions Scheme within the meaning of section 1 of the Oireachtas (Allowances to Members) Ministerial and Parliamentary Offices (Amendment) Act, 1992 (No. 3 of 1992), as amended by the Houses of the Oireachtas (Members) Pensions (Amendment) Scheme, 1992 ( S.I. No. 300 of 1992 ), the Houses of the Oireachtas (Members) Pensions (Amendment) (No. 2) Scheme, 1992 ( S.I. No. 354 of 1992 ), and the Houses of the Oireachtas (Members) Pensions (Amendment) Scheme, 1993 ( S.I. No. 111 of 1993 ); and

"the Trustees" means the trustees referred to in Clause 3 of the Scheme.

3. The Minister for Finance shall, from every payment of an additional allowance to a member of the Oireachtas, make a deduction equal to 6 per cent. of the gross amount of the payment, and the amount so deducted shall, as soon as practicable thereafter, be transferred to the account of the Trustees.

4. Each deduction referred to in Regulation 3 of these Regulations shall, on being so transferred, be regarded for the purposes of the Scheme as a contribution which the member concerned has made to the Fund on the day on which the payment from which the deduction was made became due.

EXPLANATORY NOTE.

The Oireachtas (Allowances to Members) (Amendment) Act, 1994 provides (inter alia) for the payment of allowances -- in addition to basic Parliamentary salary -- to the Chairmen of certain Oireachtas committees and the Leader of the House in Seanad Éireann. These Regulations authorise the deduction from the allowances of contributions in respect of the Houses of the Oireachtas (Members) Pensions Scheme and the payment of those contributions into the fund set up under that Scheme.
