S.I. No. 264/1994:

MERCHANT SHIPPING (CERTIFICATIONS OF DECK OFFICERS) (AMENDMENT) REGULATIONS, 1994.

MERCHANT SHIPPING (CERTIFICATIONS OF DECK OFFICERS) (AMENDMENT) REGULATIONS, 1994.

I, DAVID ANDREWS, Minister for the Marine, in exercise of the powers conferred on me by sections 3 and 8 of the Merchant Shipping (Certification of Seamen) Act, 1979 (No. 37 of 1979), and the Communications (Transfer of Departmental Administration and Ministerial Functions) Order, 1987 ( S.I. No. 91 of 1987 ), hereby make the following Regulations:

1. These Regulations may be cited as the Merchant Shipping (Certification of Deck Officers) (Amendment) Regulations, 1994, and shall come into operation on the 1st day of September, 1994.

2. The Merchant Shipping (Certification of Deck Officers) Regulations, 1988 ( S.I. No. 368 of 1988 ), are hereby amended:

( a ) by the insertion in Regulation 2 (1) after the definition of "GRT" of the following definition:

"'ice class notation' means an endorsement to a Cargo Ship Safety Construction Certificate issued by a certifying authority to the owner of a vessel which has been specifically strengthened for navigation in ice;".

( b ) by the substitution for Table A of Part I of Schedule I of the Table contained in the Schedule to these Regulations;

( c ) by the substitution for paragraph (1) of Regulation 2 of Part II of Schedule I of the following:

"(1)(A) Where a number set out in column 3 of Table A of Part I of this Schedule in relation to a certificate of competency issued under these Regulations of a particular class is followed by the indication (A), (B), (C), (D) or (E) that provision of column 3 to which the number relates shall be construed--

( a ) in the case of indication (A), as requiring the certificate or one of the certificates in question to be endorsed with the command endorsement of Master (Middle Trade),

( b ) in the case of indication (B), as requiring one of the certificates in question to be endorsed with the command endorsement of Master (Near Continental),

( c ) in the case of indication (C), as requiring the certificate in question to be endorsed with the command endorsement of Master (Near Continental) provided that where the ship is engaged on a voyage of such duration that a change of watch will become necessary, the ship shall carry an additional deck officer who is the holder of a Class 5 certificate.

( d ) in the case of indication (D), as requiring the certificate holder in question serving as second-in-command (unless his certificate is endorsed with a command endorsement) to have previously served as an officer in charge of a navigational watch on a ship of 200 GRT or more for a period of not less than 18 months, and

( e ) in the case of indication (E), as requiring the certificate holder in question serving as second-in-command (unless his certificate is endorsed with a command endorsement) to have previously served as an officer in charge of a navigational watch on a ship of 200 GRT or more for a period of not less than 12 months.

(1)(B) Where a number set out in column 3 of Table A of Part I of this Schedule in relation to a certificate of service issued under these Regulations of a particular class is followed by the indication (F) that provision of column 3 to which the number relates shall be construed as requiring a certificate holder who serves as Master and holds a Certificate of Service to also hold the following ancillary certificates:

(i) a Medical Fitness Certificate;

(ii) a Ship's Captain's Medical Training Certificate;

(iii) a Certificate of Proficiency in Survival Craft;

(iv) an Electronic Navigation Systems Certificate;

(v) a Restricted Certificate of Competency in Radiotelephony or appropriate GMDSS Certificate;

(vi) a Four Day Firefighting Certificate,

or where the certificate holder serving as second-in-command holds a Certificate of Service, to hold the certificates detailed at (i) to (vi) of this subparagraph, except that a First Aid at Sea Certificate may be substituted for a Ship's Captain's Medical Training Certificate."; and

( d ) by the insertion after "latitude 58 degrees North" in the paragraph entitled "Near Continental Trading Area" in Schedule 2 of the following:

"(vessels which hold an ice class notation recognised by the Minister may operate as far North as 60 degrees and within the entire Gulf of Finland)".

NOTES:

1. Except in the case of offshore installation supply vessels, column 3 is to be read subject to, and the meaning of (A), (B), (C), (D), (E) and (F) is to be found in paragraph 2 (1) (A) or 2 (1) (B) of, the special provisions set out in Part II of this Schedule.

2. In the case of offshore installation supply vessels column 3 is to be read subject to paragraph 3 of the special provisions set out in Part II of this Schedule.".

EXPLANATORY NOTE.

These Regulations amend manning requirements laid down in the Merchant Shipping (Certification of Deck Officers) Regulations, 1988 ( S.I. No. 368 of 1988 ).

The Regulations also permit vessels with an ice class notation to operate as far north as 60 degrees and within the entire Gulf of Finland.
