EUROPEAN COMMUNITIES (AWARD OF PUBLIC SUPPLY CONTRACTS) (AMENDMENT) REGULATIONS, 1994.

WHEREAS Council Directive No. 93/36/EEC of 14 June 1993¹, consolidates with amendments the provisions of Council Directive No. 77/62/EEC of 21 December 1976² as amended;

Now I, BERTIE AHERN, Minister for Finance, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Council Directive No. 93/36/EEC of 14 June 1993¹ hereby make the following Regulations:

1. These Regulations may be cited as the European Communities (Award of Public Supply Contracts) (Amendment) Regulations, 1994.

2. (1) In these Regulations "the Council Directive" means Council Directive No. 93/36/EEC of 14 June 1993¹.

(2) A word or expression that is used in these Regulations and is also used in the Council Directive has, unless the contrary intention appears the same meaning in these Regulations as it has in the Council Directive.

3. Any reference in the European Communities (Award of Public Supply Contracts) Regulations, 1992 ( S.I. No. 37 of 1992 ), or in any other enactment to Council Directive No. 77/62/EEC of 21 December 1976¹, or to any provision thereof shall be construed as a reference to the Council Directive or to the corresponding provision thereof in accordance with the correlation table set out in Annex VI to the Council Directive.

EXPLANATORY NOTE.

These Regulations relate to the EEC Council Directive which governs the procedures for the procurement of supplies by public bodies. In general, the procedures must be followed when contract value exceeds the relevant thresholds in the Directive.
