SOCIAL WELFARE (CLAIMS AND PAYMENTS) (AMENDMENT) REGULATIONS, 1994. |

The Minister for Social Welfare in exercise of the powers conferred on him by section 4 of the Social Welfare (Consolidation) Act, 1993 (No. 27 of 1993) and section 212 of that Act (as amended by section 28 of the Social Welfare Act, 1994 (No. 4 of 1994)), hereby makes the following Regulations:-- |

Construction and collective citation. | ||
1. (1) The Regulations may be cited as the Social Welfare (Claims and Payments) (Amendment) Regulations, 1994. |
||
(2) These Regulations and the Social Welfare (Claims and Payments) Regulations, 1993 shall be construed together as one and may be cited together as the Social Welfare (Claims and Payments) Regulations, 1993 to 1994. |
||
Prescribed time for furnishing information. | ||
2. The Social Welfare (Claims and Payments) Regulations, 1993 ( S.I. No. 189 of 1993 ) are hereby amended by the insertion after article 10 of the following article: |
||
"10A. The period prescribed for the furnishing of information and production of documents required by a social welfare inspector under the provisions of section 212 (2) of the Social Welfare (Consolidation) Act, 1993 shall be-- |
||
( a ) in the case of the personal representative of a person who was at any time in receipt of any benefit, 30 days, and |
||
( b ) in any other case, 21 days, |
||
following the date of issue of a notification in writing sent by registered post to the person from whom the said information and documents, as the case may be, are sought.". |

EXPLANATORY NOTE. |
||
Section 212 (2) of the Social Welfare (Consolidation) Act, 1993 provides that social welfare inspectors may investigate all matters in relation to social welfare payments. Inspectors can require |
||
--a claimant or beneficiary, his spouse and his employer, |
||
--a person in charge of a child in respect of whom Child Benefit is claimed, |
||
--a liable relative and his employer, and |
||
--the personal representative of any deceased beneficiary. |
||
to provide such information and documents as they may reasonably require within a prescribed period. |
||
These Regulations require a personal representative to provide information and documents sought by a social welfare inspector within a period of 30 days and any other person to provide such information and documents within a period of 21 days, following the issue of a written notification sent by registered post. |
