S.I. No. 330/1994:

LOCAL GOVERNMENT (DUBLIN) ACT, 1993 (SECTION 9 (7)) REGULATIONS, 1994.

LOCAL GOVERNMENT (DUBLIN) ACT, 1993 (SECTION 9 (7)) REGULATIONS, 1994.

The Minister for the Environment in exercise of the powers conferred on him by Section 9 (7) of the Local Government (Dublin) Act, 1993 (No. 31 of 1993), hereby makes the following Regulations:--

1. These Regulations may be cited as the Local Government (Dublin) Act, 1993 (Section 9 (7)) Regulations, 1994.

2. In these Regulations--

"the Act" means the Local Government (Dublin) Act, 1993 (No. 31 of 1993);

"appropriate authority" means any of the councils of the administrative counties of Dun Laoghaire-Rathdown, Fingal or South Dublin.

3. ( a ) Before making application to the Government pursuant to Section 9 (4) of the Act to make an order to change the name of its administrative county, an appropriate authority shall give public notice, in one or more newspapers circulating in the said administrative county, of its intention to make such application.

( b ) The public notice shall--

(i) invite written submissions in relation to the proposed change of name,

(ii) specify the existing and the proposed names of the administrative county in the Irish and English languages, and

(iii) specify a period, being not less than one month from the day of publication of the notice referred to in paragraph (a) of this article, for the making of submissions and shall state that any submissions received after the expiration of that period shall not be considered.

4. An appropriate authority referred to in article 3 (a) of these Regulations shall, on the publication of the notice referred to in that article, or as soon as may be thereafter, send a copy of such notice to the following--

Each of the other appropriate authorities;

The Right Honourable the Lord Mayor, Aldermen and Burgesses of Dublin;

Each local authority whose functional area is within the administrative county of the applicant appropriate authority; and

An Coimisiún Logainmneacha.

5. An application to the Government under Section 9 (4) of the Act shall be accompanied by:--

( a ) a certified copy of the resolution of the decision to make the application, which said resolution, shall specify the existing and the proposed names, in the Irish and English languages, of the administrative county, and

( b ) a list of any alternative names proposed in the submissions made to the appropriate authority.

EXPLANATORY NOTE.

These regulations set out the procedures relating to an application to the Government for a change of name of any of the administrative counties of Dun Laoghaire-Rathdown, Fingal or South Dublin, pursuant to the provisions of Section 9 of the Local Government (Dublin) Act, 1993 .
