ROAD VEHICLES (REGISTRATION AND LICENSING) (AMENDMENT) REGULATIONS, 1995.

ROAD VEHICLES (REGISTRATION AND LICENSING) (AMENDMENT) REGULATIONS, 1995.

The Minister for the Environment in exercise of the powers conferred on him by sections 5 and 12 of the Roads Act, 1920, sections 1 and 3 of the Finance (Excise Duties) (Vehicles) Act, 1952 (No. 24 of 1952), section 20 of the Finance Act, 1958 (No. 25 of 1958), section 4 of the Finance (Excise Duties) (Vehicles) (Amendment) Act, 1960 (No. 1 of 1960), section 21 of the Finance Act, 1960 (No. 19 of 1960), sections 3 and 123 of the Road Traffic Act, 1961 (No. 24 of 1961), sections 65 and 77 of the Finance Act, 1976 (No. 16 of 1976), sections 19 , 20 and 21 of the Finance (No. 2) Act, 1992 (No. 28 of 1992) and sections 60 and 61 of the Finance Act, 1993 (No. 13 of 1993) as amended by sections 86 and 87 of the Finance Act, 1994 (No. 13 of 1994), hereby makes the following Regulations:--

Citation, interpretation etc.

1. (1) These Regulations may be cited as the Road Vehicles (Registration and Licensing) (Amendment) Regulations. 1995.

(2) These Regulations and the Road Vehicles (Registration and Licensing) Regulations, 1992 to 1994 shall be construed as one and may be cited together as the Road Vehicles (Registration and Licensing) Regulations, 1992 to 1995.

(3) In these Regulations "the Regulations of 1992" means the Road Vehicles (Registration and Licensing) (Amendment) Regulations, 1992 ( S.I. No. 385 of 1992 ).

(4) These Regulations shall come into operation on the 1st day of July, 1995.
Change of Address

2. Article 9 of the Regulations of 1992 is hereby amended by the substitution of the following sub-article for sub-article (4) thereof--

"(4) On a change of address, the owner, other than a motor dealer, of a vehicle which was first licensed in the State on or after the 1st day of January, 1993 shall enter particulars of the owner's new address in the space provided in the licensing certificate and shall forthwith deliver the licensing certificate with such particulars entered in it to the Minister who shall note the change of address, issue an amended vehicle licensing certificate to the owner and notify the appropriate licensing authority.".
Sale of Vehicle

3. Article 10 of the Regulations of 1992 is hereby amended

( a ) by the substitution for sub-article (8) of the following sub-article:--

"(8) ( a ) On the sale of a vehicle which was first licensed in the State on or after the 1st day of January, 1993 the new owner, other than a motor dealer, shall complete Part B of the vehicle licensing certificate and the new owner shall retain part A of the vehicle licensing certificate and the owner transferring the vehicle shall deliver the completed Part B of the vehicle licensing certificate to the Minister.

( b ) on receipt of Part B of the vehicle licensing certificate the Minister shall note the change of owner and issue a vehicle licensing certificate to the new owner and notify the appropriate licensing authority.", and

( b ) by the addition of the following sub-article:--

"(9) On the sale of a vehicle which was first licensed in the State on or after the 1st day of January, 1993, the new owner, if a motor dealer, shall complete Part B of the Form R.F. 105 referred to in the Second Schedule to these Regulations and the owner, including a motor dealer, transferring the vehicle shall complete Part A and shall deliver the completed Form R.F. 105 to the Minister and shall deliver the vehicle licensing certificate to the new owner.".

4. The Regulations of 1992 are hereby amended by the substitution of the following Schedule for the Second Schedule thereto:--

EXPLANATORY NOTE.

These Regulations provide for changes to the procedures relating to the notification of ownership changes where vehicles registered on or after 1 January, 1993 are sold to motor dealers and the issue of Vehicle Licensing Certificates in such cases.
