CONVEYANCE OF EXPLOSIVES (AMENDMENT) BYELAWS, 1995. |

I, NORA OWEN, Minister for Justice, in exercise of the powers conferred on me by sections 37 and 39 of the Explosives Act, 1875, as adapted, hereby make the following byelaws: |
||
1. (1) These byelaws may be cited as the Conveyance of Explosives (Amendment) Byelaws, 1995. |
||
(2) These byelaws shall come into operation on the 1st day of October, 1995. |
||
2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these byelaws. |
||
3. The Schedule to the Conveyance of Explosives Byelaws, 1955 ( S.I. No. 38 of 1955 ), is hereby amended-- |
||
( a ) by the substitution for paragraph 3 (b) (viii) of the following: |
||
"(viii) That the engine be not run when the doors of the freight compartment are open or during loading or unloading of explosives except where the vehicle is equipped with an exhaust heat shield and a loading mechanism in respect of which the engine provides power.", and |
||
( b ) by the insertion in paragraph 3 (b) of the following: |
||
"(xi) That the engine be not run during refuelling.". |

EXPLANATORY NOTE. |
||
These byelaws amend the Schedule to the Conveyance of Explosives Bye-laws, 1955 ( S.I. No. 38 of 1955 ) by providing that the engine of an explosive truck must not be running during refueling. Moreover, the engine cannot be running during loading/unloading operations or when the doors of the freight compartment are open except where the vehicle is equipped with an engine powered lifting mechanism and a protected exhaust. |
