TELECOMMUNICATIONS (AMENDMENT) (NO. 5) SCHEME, 1995.

TELECOMMUNICATIONS (AMENDMENT) (NO. 5) SCHEME, 1995.

Bord Telecom Éireann, in exercise of the powers conferred on it by Section 90 of the Postal and Telecommunications Service Act, 1983 (No. 24 of 1983) hereby makes the following Scheme:

1. This Scheme may be cited as the Telecommunications (Amendment) (No. 5) Scheme, 1995

2. (1) The collective citation "the Telecommunications Scheme, 1994 and 1995" includes this Scheme.

(2) Article 4 (e) shall be deemed to have come into operation on 14 June 1995.

(3) Article 4 (q) shall be deemed to have come into operation on 1 September 1995.

(4) Article 4 (a), 4 (b), 4 (c), 4 (d), 4 (h), 4 (j), 4 (k), 4 (m), 4 (n), 4 (o), and 4 (t) shall be deemed to have come into operation on 3 October 1995.

(5) Article 4 (g) and 4 (p) shall be deemed to have come into operation on 1 November 1995.

(6) Article 4 (f), 4 (i), 4 (r) and 4 (s) shall come into operation on 1 December 1995.

(7) Article 4 (l) and 4 (u) shall come into operation on 1 February 1996.

3. The Interpretation Act, 1937 (No. 38 of 1937) applies to this Scheme.

4. The Telecommunications Scheme, 1994 ( S.I. No. 177 of 1994 ) is hereby amended by.

( a ) the insertion of the following, after the definition of "1850 call" In Article 5 (1) thereof:

"'1890 call' means a telephone call which is made by a telephone subscriber or caller, in which the connection of the call is effected by automatic switching, which call is connected to the telephone exchange line of a telephone subscriber identifiable by an 1890 number allocated by Bord Telecom Éireann and which call is in part charged to and payable by the telephone subscriber identified by the 1890 number and in part charged to and payable by the telephone subscriber or caller who makes the call;";

(b) the insertion of the following, after definition of "Local call" In Article 5 (1) thereof:

"mailbox" means an electronic medium for storing telephonic messages;";

(c) the insertion of the following, after the definition of "premises" in Article 5 (1) thereof:

"'Premium Rate Telephone Service' means a telephone service in respect of which part of the telephone charge paid or payable by a telephone subscriber or caller in respect of the call is passed by Bord Telecom Éireann or another telecommunications network operator, directly or indirectly, to an individual, organisation or company which is participating in the provision of the service;";

(d) the insertion of the following, after the definition of "reverse charge call" In article 5 (1) thereof:

"'Service Provider' means a person, other than Bord Telecom Éireann, which participates with Bord Telecom Éireann (or with another telecommunications network operator within or outside the State) in the provision of a Premium Rate Telephone Service;";

(e) the addition of the following Article after Article 19 thereof:

"19A (1) Bord Telecom Éireann may provide a facility (in this Scheme referred to as a "B Trunk Volume Discount" facility) to telephone subscribers generally or to such groups of telephone subscribers as it shall determine whereby a telephone subscriber may, on payment of a monthly subscription, receive a discount on its "Eligible B Trunk Calls" on a single telephone account. The B Trunk Volume Discount shall be calculated as set out in Part 4 of Section VII of Part 6 of the First Schedule to this Scheme. Bord Telecom Éireann may at its absolute discretion withdraw the B Trunk Volume Discount facility from all or any subscribers.

(2) For the purpose of this Scheme "Eligible B Trunk Calls" shall mean subscriber dialled calls (excluding Chargecard calls, Eirpac calls, calls made to Eircell equipment and unrestricted 64K calls made by use of the Integrated Service Digital Network Facility) made between exchanges in the State and from exchanges in the State to exchanges in Northern Ireland where the distance between Group Centres of exchanges concerned exceeds 56kms.

(3) It shall be a condition of the application of the B Trunk Volume Discount facility that:

(i) the subscriber pays the monthly subscription charge set out in Part 4 of Section VII of Part 6 of the First Schedule hereto:

(ii) Eligible B Trunk Calls shall be made only from a single premises occupied by the subscriber; and

(iii) Eligible B Trunk Calls shall be made only by the subscriber or by employees of the subscriber.";

(4) Total Volume Discounts or International Volume Discounts will be applied to the Subscriber's account after the 'B' Trunk Discount has been allowed.

(f) the insertion of the following Article after Article 19A thereof:

"19B (1) Bord Telecom Éireann may provide a facility (in this Scheme referred to as "International Term Discount" facility) to telephone subscribers generally or to such groups of telephone subscribers as it shall determine whereby a telephone subscriber may, on payment of a monthly subscription, receive a discount on its "Eligible International Calls" on a single telephone account. The International Term Discount shall be calculated as set out in Part 5 of Section VII of Part 6 of the First Schedule of this Scheme. Bord Telecom Éireann may at its absolute discretion withdraw the International Term Volume Discount facility from all or any subscribers.

(2) For the purpose of this Scheme "Eligible International Calls" shall mean subscriber dialled calls made from a telephone exchange line rented by the subscriber to telephones outside the State (excluding Northern Ireland) but excluding subscriber dialled calls made by use of the International Virtual Private Network facility and also excluding Chargecard calls, Eirpac calls, Eircell calls, unrestricted 64 Kb calls made by use of the Integrated Services Digital Network facility and calls made to Premium Rate Telephone Services.

(3) It shall be a condition of the application of the International Term Discount that:

(i) accounts to which the International Term Discount applies must be discharged in full within 14 days or by means of a direct debit mandate approved by Bord Telecom Éireann; and

(ii) Eligible International Calls shall be made only from a single premises, occupied by the subscriber; and

(iii) Eligible International Calls shall be made by the subscriber or by employees of the subscriber.";

(4) Total Volume Discounts or International Volume Discounts will be applied to the Subscriber's account after the "International Term" Discount has been allowed.

(g) the insertion of the following Article after Article 20A thereof:

"20B (1) Bord Telecom Éireann may provide a facility (in this Scheme referred to as "National 18XX Discount" facility) to telephone subscribers generally or to such groups of telephone subscribers as it shall determine whereby a telephone subscriber may, on payment of a monthly subscription, receive a discount on its "Eligible National 18XX Calls" on a single telephone account. The national 18XX Discount shall be calculated as set out in Part 6 of Section VII of Part 6 of the First Schedule to this Scheme. Bord Telecom Éireann may at its absolute discretion withdraw the National 18XX Discount facility from all or any subscribers.

(2) For the purpose of this Scheme "Eligible National 18XX Calls" shall mean Freefone 1800 calls, 1850 calls and 1890 calls.

(3) It shall be a condition of the application of the National 18XX Discount that:

(i) accounts to which the National 18XX Discount applies must be discharged in full within 14 days or by means of direct debit mandate approved by Bord Telecom Éireann; and

(ii) the subscriber pays the monthly subscription charge set out in Part 6 of Section VII of Part 6 of the First Schedule hereto; and

(iii) Eligible National 18XX Calls shall be made only to a premises occupied by the subscriber; and

(iv) Eligible National 18XX Calls shall be intended for and be answered by the subscriber or employees of the subscriber only.";

(h) the insertion of the following Article 62 therein;

"There shall be charged to and payable for subscriber dialled calls to Premium Rate Telephone Services the appropriate charge specified in Section X of Part 6 of the First Schedule hereto.";

(i) the revocation of Article 63 (12) therein;

(j) the addition of the following paragraph (16) to Article 63 thereof:

"(16) Bord Telecom Éireann may provide a facility (in this Scheme referred to as the "Call Answering facility") to telephone subscribers generally or to such groups of telephone subscribers as it shall determine whereby incoming telephone calls to a telephone exchange line are diverted to a mailbox if the telephone call is not answered or the telephone exchange line is busy.

There shall be charged to the telephone subscriber and paid by him in respect of the Call Answering facility the charges specified in Section 1 of Part 6. of the First Schedule to this Scheme.";

(k) the addition of the following paragraph (17) to Article 63 thereof:

"63 (17) Bord Telecom Éireann may provide a facility (in this Scheme referred to as "Premium Rate Telephone Service" facility) whereby subscribers may make calls to Premium Rate Telephone Services provided by Service Providers. There shall be charged to and payable by the Service Provider in respect of the Premium Rate Telephone Service facility the appropriate charges specified in Section X of Part 6 of the First Schedule to this Scheme.";

(l) the substitution of the following Part 1 of the First Schedule for Part 1 of the First Schedule thereto:

(1) The ITU.T recommendations referenced refer to the 1988 version. ETSI has been requested to carry out further work on standards for leased lines.

(11) This refers to the time duration (in hours) within which 80% of leased lines of the same type are repaired. The time duration starts when a failure message is given to the appropriate unit in Bord Telecom Éireann and finishes when the line is re-established and in appropriate cases notified back to the user.

(12) The description above of the Typical Delivery Period, Average Delivery Period, Typical Repair Time and Average Repair Time does not constitute a legally binding commitment on the part of Bord Telecom Éireann to deliver or repair leased lines within such periods or times.
