I, IVAN YATES, Minister for Agriculture, Food and Forestry, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972) and for the purposes of giving effect to Commission Directive 95/11/EC of 4 May, 19951, Commission Directive 95/37/EC of 18 July 19952 and Commission Directive 95/55/EC of 31 October 19953 and for the purpose of giving further effect to Council Directive 70/524/EEC of 23 November, 19704 as amended, hereby make the following Regulations:

1. (1) These Regulations may be cited as the European Communities (Additives in Feedingstuffs) (Amendment) Regulations, 1996.

(2) The European Communities (Additives in Feedingstuffs) Regulations 1989 to 1995, and these Regulations may be cited together as the European Communities (Additives in Feedingstuffs) Regulations, 1989 to 1996.

2. In these Regulations "the Regulations of 1989" means the European Communities (Additives in Feedingstuffs) Regulations, 1989 ( S.I. No. 49 of 1989 ).

3. The Regulations of 1989 are hereby amended by the substitution:--

( a ) in Regulation 2 (1) for the definition of "Council Directive", of the definition set out in the First Schedule to these Regulations;

( b ) of the following Regulation for Regulation 28:

"28. Every person concerned shall comply with the provisions of Council Directive 87/153/EEC5 fixing guidelines for the assessment of additives in animal nutrition, as amended by Council Directives 94/40/EC6 and 95/11/EC7.";

EXPLANATORY NOTE.

These Regulations amend the European Communities (Additives in Feedingstuffs) Regulations, 1989, so as to give effect to Commission Directive 95/11/EC, which amends Council Directive 87/153/EEC fixing guidelines for the assessment of additives in animal nutrition, and to Commission Directives 95/37/EC and 95/55/EC, which amend Annexes I and II to Council Directive 70/524/EEC concerning additives in feedingstuffs in respect of the additives authorised in feedingstuffs and their conditions of use.
