EUROPEAN COMMUNITIES (SEED OF FODDER PLANTS) (AMENDMENT) REGULATIONS, 1997.

EUROPEAN COMMUNITIES (SEED OF FODDER PLANTS) (AMENDMENT) REGULATIONS, 1997.

I, IVAN YATES, Minister for Agriculture, Food and Forestry, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Commission Directive 96/18/EC of 19 March 19961 and Council Directive 96/72/EC of 18 November 19962 in so far as they relate to seed of fodder plants, hereby make the following Regulations:

1. (1) These Regulations may be cited as the European Communities (Seed of Fodder Plants) (Amendment) Regulations, 1997 and shall come into operation on the 3rd day of February, 1997.

(2) The European Communities (Seed of Fodder Plants) Regulations, 1981 to 1996 and these Regulations may be cited together as the European Communities (Seed of Fodder Plants) Regulations, 1981 to 1997 and shall be construed together as one.

2. In these Regulations--

"the Principal Regulations" means the European Communities (Seed of Fodder Plants) Regulations, 1981 ( S.I. No. 112 of 1981 );

"the Regulations of 1991" means the European Communities (Seed of Fodder Plants) (Amendment) Regulations, 1991 ( S.I. No. 110 of 1991 ).

3. Regulation 2 of the Principal Regulations is hereby amended--

( a ) in paragraph (1)

(i) by the substitution of the following definition for the definition "small EEC A packages":

' "small EC A packages" means packages containing a mixture of seeds of fodder plants and which are not intended for the production of plants for fodder purposes being packages with a net weight not exceeding 2 kg excluding, if contained in the package, granulated pesticides, pelleting substances or other solid additives;'

and

(ii) by the substitution of the following definition for the definition "small EEC B packages":

' "small EC B packages" means packages containing certified seed or commercial seed or packages other than small EC A packages, containing a mixture of seeds of fodder plants being (in any case) packages with a net weight not exceeding 10 kg excluding, if contained in the package, granulated pesticides, pelleting substances or other solid additives;

and

( b ) in paragraph (2) (as amended by the Regulations of 1991) by the substitution for "and Commission Directive 92/19/EEC of 23 March 1992." of "Commission Directive 92/19/EEC of 23 March 1992, Commission Directive 96/18/EC of 19 March 1996 and Council Directive 96/72/EC of 18 November 1996.".

4. Regulation 7 of the Principal Regulations is hereby amended--

( a ) in paragraph (1):

(i) by the substitution of "EC" for "EEC",

( b ) in paragraph (3):

(i) by the substitution of "EC" for "EEC",

and

( c ) in paragraph (4):

(i) by the substitution of "EC" for "EEC".

5. Regulation 8 of the Principal Regulations is hereby amended--

( a ) in paragraph (1):

(i) by the substitution of "EC" for "EEC"

and

( b ) in paragraph (4):

(i) by the substitution of "EC" for "EEC".

6. Regulation 12 of the Principal Regulations is hereby amended by the substitution in paragraph (8) of the following definition for the definition "seed packer":

' "seed packer" means a person who is in the course of a business packs seed into small EC packages;'.

7. Annex III of the Schedule to the Principal Regulations is hereby amended by the substitution of '25' for '20' in column 2 of the Table in the case of

'Lupinus albus

Lupinus angustifolius

Lupinus luteus

Pisum sativum

Vicia faba

Vicia sativa'.

8. Annex IV of the Schedule to the Principal Regulations is hereby amended--

( a ) in paragraph A.1--

(i) by the substitution of "EC" for "EEC" in clause (a).1,

(ii) by the substitution of "EC" for "EEC" in clause (b).1,

( b ) in paragraph B--

(i) by the substitution of "EC" for "EEC" in sub-paragraph (a).1,

(ii) by the substitution of "EC" for "EEC" in sub-paragraph (b).1,

(iii) by the substitution of "EC" for "EEC" in sub-paragraph (c).1,

(iv) by the substitution of "EC" for "EEC" in sub-paragraph (c).3,

(v) by the substitution of "EC" for "EEC" in sub-paragraph (c).4,

(vi) by the substitution of "EC" for "EEC" in sub-paragraph (c).5,

(vii) by the substitution of "EC" for "EEC" in sub-paragraph (c).6,

(viii) by the substitution of "EC" for "EEC" in sub-paragraph (c).7.

EXPLANATORY NOTE.

This Regulation replaces the abbreviation "EEC" with "EC" with regard to packaging and labelling of seeds. The maximum weights for seed lots of certain species have also been revised.
